MEMORANDUM Sub: Conversion/issue of permit in respect of Foreign Flight Radio Telephone Operators Licenses (FRTOLs) A. In light of the current international practices and requirements of International Civil Aviation Organisation (ICAO), the procedures of conversion of FRTOLs in India have been reviewed. Accordingly, it has been decided by this Ministry that the following modified procedures will be adopted for conversion/issue of Permit against a Foreign FRTOL: i)

The holders of Commercial Pilot License (CPL), Airline Transport Pilot License (ATPL) and Flight Engineers License (FEL) from all Commonwealth countries and Philippines will be considered for issue of Indian Radio Telephony Permits directly in lieu of their foreign Flight Radio Telephony Licenses (FRTOLs) provided their FRTOLs are issued from the same Administration from where their Flight Crew Licenses (CPL/ATPL/FEL) have been issued.

ii)

The Foreign FRTOLs holders not meeting the above criterion will be required to pass the Part I of RTR (A) examination conducted by this Ministry, for enabling them to have Indian Permit.

iii)

The Foreign FRTOLs, issued from countries/Administrations other than Commonwealth and Philippines, will not be entitled either for direct conversion or waiver for the Part II RTR (A) examination.

iv)

The validity of the converted Foreign FRTOLs, based upon passing of Part-1 RTR (A) examination, will be for a maximum period of 3 years with effect from date of declaration of examination results or till the validity of Foreign FRTOL; whichever is less. The converted license can be renewed every 3 years subject to fulfilling of renewal criteria of RTR (A) licenses and validity of Foreign FRTOL.

v)

The validity of the directly converted Foreign FRTOLs (refer Para(i) above) will be till the validity of Foreign FRTOL or Pilot/Flight Engineer License or 3 years; whichever is earlier. It will be renewable every 3 years subject to fulfilling of existing RTR (A) renewal criteria and validity of concerned foreign licenses (FRTOL and CPL/ATPL/FEL).

vi)

The instructions for filling up the Application form(AF-1) for fresh Permits are enclosed as Annexure-I

These procedures super cede earlier memorandum issued in this regard dated 7/2/2008 and come into force with effect from 15th January’2009. B.

Refer memo. of even number dated 13/03/2008: With a view to facilitate the transition, in accordance with the above guidelines (Para “A” above), a further extension of six months beyond 31/12/2008 i.e. up to 30.06.2009 will be granted to the Renewal cases covered under the memo (dated 13/03/2008), subject to fulfilling of existing RTR (A) renewal criteria. No further extensions will be granted in this regard.

Instructions for filling in the application form: 1. (Ref Sl.1,2,3,4,5,10&11 of the application form) The applicant should provide the information as required. 2. (Ref Sl. 6 of the application form) The name recorded against Sl.4 &5 should be identical, except as noted below, and hence the response against Sl. 6 should be YES. Exception: The name recorded against above columns may begin at some columns with the surname first, followed by remaining part(s) of the name, whereas the name recorded against some other columns may have surname at the end. For example, if the Name is ABC LMN XYZ, where XYZ is surname, the following combination is permissible. Name (as recorded in FRTO) And

Except for the above difference in the name, no other difference is acceptable to the Ministry. In the case of there being any difference, it is the responsibility of the applicant to get his/her name corrected by the foreign FRTO issuing authority. (No other approach in this regard is acceptable). 3. (Declaration of the application form) The applicant should put his signature exactly the same way at the bottom of the Declaration as made in the foreign FRTO and other Flight Crew License. 4. (Ref Sl. 7 of the application form) The applicant should record his/her name in Hindi, preferably as recorded in the Certificate/Degree awarded by the School Examination Board/University. In case the applicant does not record his/her name in Hindi, the Ministry will make the necessary translation of the name in Hindi, and any subsequent request to rectify the error, if any -3arising out of inappropriate/inaccurate translation of the name, may not be entertained by the Ministry. 5. (Ref Sl. 8 of the application form) The response to Sl.8 should be YES. If the response is NO, the application will be treated as incorrect/incomplete, and hence will not be acted upon by the Ministry.

6. (Ref Sl. 9 of the application) (A) The applicant is required to submit the duly attested xerox copies of the following documents/papers: (I) Foreign FRTOL and Pilot/FE license (all the pages); (ii) Passport (only those pages supporting the personal particulars recorded in the foreign FRTOL, Pilot/FE license and the VISA for the country where from the FRTOL and Pilot/FE license was issued); (iii) A Bank draft of Rs. 50/- obtained from any branch of the STATE BANK OF INDIA, and drawn in favour of "PAY AND ACCOUNTS OFFICER (HQ), DEPARTMENT OF TELECOMMUNICATIONS, NEW DELHI” PAYABLE AT THE STATE BANK OF INDIA, New Delhi Main Branch, Parliament Street, New Delhi (code 691) or Service Branch (code 7687) (in case of payment from New Delhi, Banker’s cheque from STATE BANK OF INDIA is also acceptable). (B) Every xeroxed page, as mentioned in (A) above, should be attested by either (i) a gazetted officer of the Central or State Government, or (ii) a Member of Parliament of State Legislature (The applicant should ensure that the person attesting the paper(s) should record his/her name as well as complete postal address. Attestation by any person other than mentioned here is not acceptable) (C) All the xeroxed pages should be legible; in particular the passport number should be easily readable on the xerox copies of the passport. FRTOL, Pilot/FE licence number should be recorded on every xerox page of the licenses by the person attesting these Licenses. 7. General instruction/information: (A) The application should be duly typed and the envelope containing the application should be super scribed in bold letters with “PERMIT AGAINST Foreign FRTOL” (B) The incomplete/incorrect application may not be responded to by the Ministry. (C) Processing of correct application may take generally about 8 weeks. (D) Application duly completed should reach the Assistant Wireless Adviser to Govt. of India, WPC Wing, COP Section, Department of Telecom, 619, Sanchar Bhawan, 20, Ashoka Road, New Delhi-110001. Note: The application form can be typed and distributed freely as long as the format and content is strictly followed.
