The charge of leaving the scene of an accident in this matter arises from an incident that occurred in front of 198, Queen St., Brantford, ON, on August 21, 2009.

The person charged with leaving the scene of the accident in this matter is:

Brent Small, d.o.b 85.08.30 of 575 Oak St., Brantford, ON

The circumstances of the offence are the follows:

On August 21 2009, Charles Yaworsky was walking southbound along the west side of Queen St. He then decided to cross the street to the east side near the intersection of Queen St. and King St. at approximately 2120.

Charles noticed a couple that looked like they were having an argument in a Laundromat on the east side of King St. at the corner of Queen St. when Mr. Yaworsky was sideswiped by a vehicle. The vehicle did not appear to have its headlights on. He never the saw the vehicle but prior to being hit, Charles heard a loud blast of music. He doesn’t remember anything else because he was momentarily unconscious after being struck by the car and thrown to the sidewalk. Charles was struck by the passenger door.

The incident was witnesses in part by Mary BLUNT, 202 Queen St., Brantford, ON, and George Lynden, 71 Duke St., Brantford, ON. LYNDEN was walking his dog southbound on the eastside of Queen St. at sometime after 2100 and saw the incident. BLUNT was in her living room and heard a loud thud and scream but never saw the incident.

LYNDEN never say the suspect but got a description of the vehicle. It was described as a mid to late 1990’s model, maybe General Motors product. It was silver or grey with four doors, and an Ontario License plate with the first two letters as “AJ”

Yaworsky was transported by ambulance to General Hospital, where he was needed 5 stitches to close the gash on his head, that his left arm is bruised but not broken, and that he has other minor cuts and scrapes possibly caused by him being thrown to the sidewalk.

A call from dispatch came through regarding a compliant to see Maurice Small at Oak St., who is complaining that his 18 year-old-son took the family car without his permission. At 2325 Maurice was interviewed SMALL reports that earlier in the evening, his son Brent told him that he was going out with some friends. At approximately 2100, Maurice noticed that his car was missing from driveway but did not report it stolen at the time because he suspect that his son, despite not having his license, might have taken it. Brent Small returned home with the car at 2315, but Maurice did not report that the car was returned because he was wanted his son to be taught a lesson. At 0012, August 22 Brent Small was interviewed, he admits that he took the car and went joyriding with a couple of friends. He claims to have nothing to do with the incident but after examining the car there was a large scratch on the passenger door. At 0025, August 22, 2009 Brent Smalls was arrested for leaving the scene of an accident and for driving without a license. He was read his rights. SMALL was transported to the Downtown Division.



PC Brandon Dixon 0792 Monday, 09.08.21 Weather is clear Roads are fine 1900 Report for duty Downtown Division 2125 Dispatched by radio to Queen St., Brantford Ontario and find a male sitting on the curb bleeding heavily from a cut on the forehead and may have a broken arm. He is getting first aid by a female. 2136 An ambulance arrives at the scene. The man identifies himself as Charles Yaworsky. Address: 21 Bold St., Brantford ON N4C. 1T1 DOB: 30 May 1946 SIN: 471 832 136 Telephone: 519-555-1212 Yaworsky was walking southbound along the west side of Queen St. and decided to cross the street to the east side near the intersection of Queen St. and King St. at approximately 2120. He noticed a couple that looked to appear to be arguing in a Laundromat on the east side of King St. at the corner of Queens St. He was then sideswiped by a vehicle that he said “ didn’t appear to have its lights on”. Yaworsky did not the see vehicle but heard music before he was hit. 2140 Charles Yaworsky was transported to General Hospital, 1223 Festival St., by District Ambulance Services . Two witnesses come forward at this time. Mary Blunt and George Lynden. Blunt was in her living room at the time of the incident but heard a loud thud and scream. She then came and to assist the victim. Blunt is a registered nurse and began administrating first aid. She also called 911 on her cell phone. She stated that “ it looked like his left arm had been broken”. Yaworsky then regained consciousness but didn’t say anything. George Lynden was walking his dog at the time of the incident south bound of the east side of Queen St. As he was walking opposite Maggie’s Bar and Grill at 130 Queen St., about two blocks north of King St., he saw a man leave the bar. Lynden noticed this because the man looked unsteady on his feet and described the man as “ middle aged, wearing a green t-shirt and dark pants”. Lynden watched as the man fell several times and occasionally walked on to the road heading south bound. He saw the man approach the intersection of Queens and King St.. Lynden saw the car coming very fast. The victim was hit on the passenger door. The car was described to General Motors product, silver or grey, four door, with Ontario license that read AJ. Leave both witnesses with incident number ask them to call if they think of anything else. 2230 I arrive at the General Hospital to interview Yaworsky. He is conscious and admits to having 3 or 4 beers at Maggie’s Bar and Grill in the hour or so he was there. I then leave the hospital after broadcasting a description of the car allegedly involved with the incident and resume general patrol 2320 Receive a call from dispatch directing you to see Maurice Small at 575 Oak St., who is complaining that his 18-year-old son took the family car without permission. 2325 Arrive at 575 Oak St., and interview Small. The basic facts are the following: Addresses: 575 Oak St. Brantford, ON, N3T 5V2 DOB: 15 October 1958 SIN: 428 716 276 Telephone: 519-555-3022 Drivers License: S6018-40715-81015 (ON) G The basic facts about the vehicle are: Vehicle: Saturn SL-1 Year: 1997 Colour: Silver Plate: AJXW 846 Ontario Valtag: 1148131 VIN: 1G8LM5281RS393176 Insured by: Boyson Insurance Brokers Policy Number: NY93BC1176 Maurice said that his son, Brent Smalls took the vehicle without permission and with no license.

Name: Brent Maurice Small Address: Oak St., Brantford, ON DOB: 30 August 1988 Physical Description: brown hair, hazel eyes, no facial hair, no glasses, no outstanding features. Medium build, fair complexion. Height: 180cm Weight 73kg. 0012 Begin interview with Brent Small. He admits to taking the car without permission out with a couple of friends. Brent said “ they were driving on Queen St. at about 2130. I noticed a police officer in front of a house so I turned off the lights and sped up”. He was worried about getting stopped with a license. He also said that the radio was quite loud. I told Brent about the hit and run but he claims he had nothing to do with it but he did notice a man staggering on the sidewalk on Queens St. I examined the car and found a large scratch on the passenger door. 0025 I arrest Brent Small for leaving the scene of a accident and driving without a license. I read him his rights and is being transported to the Downtown Division.
