TOWNSHIP COUNCIL September 11th, 2006 – Agenda Meeting President Apai called the meeting to order at 6:30 pm and read the Open Public Meetings statement: The notice requirements provided for in the Open Public Meetings Act have been satisfied. Notice of this meeting was properly given as per N.J.S.A. 10:4-18 and was transmitted to the Times of Trenton and the Trentonian on January 4th, 2006 for publication on January 6th, 2006. Documentation and notice have been filed with the Clerk of the Township of Ewing and posted in the Ewing Township Municipal Complex as is required by law. ROLL CALL ƒ ƒ ƒ ƒ ƒ

DISCUSSION: President Apai introduced a resolution and an ordinance authorizing the Township of Ewing to enter an agreement of sale with Ewing Lofts and Studios, Inc. for the lease purchase of various lands and buildings in the Township of Ewing so that the Township may construct a new animal shelter. Benjamin Keating of Johnson Atilier described the proposed development of the Kuhn Jacobs and Hibbert buildings. Janet McLaughlin, Chair of the Redevelopment Agency and Anthony Carabelli, Executive Director, also spoke in support of the project. The resolution and the ordinance were approved for action. At 6:40, Ms. Wollert moved to meet in closed session to discuss matters of public safety, seconded by Mr. Steinmann. At 7:07 pm, the meeting was reopened and Mr. McManimon discussed the proposed agreement with Mercer County regarding purchase of the Jewish Community Center (JCC) property. It was agreed to put an Ordinance and Resolution for this purpose on the agenda for the Tuesday meeting. He also discussed the need to approve a resolution for participating with the Improvement Authority for the lease purchase of capital equipment. After discussion, Council agreed to include it on the agenda but that it would be pulled if there were any substantive questions. President Apai gave the floor to attorney Schwartz who discussed an ordinance regarding the use of storage trailers. This ordinance was approved for action. President Apai presented the consent agenda for consideration. CONSENT AGENDA: 1.

Authorization for the Chief Financial Officer to pay Township bills in the amount of $195,701.22.

2. Approval of minutes of the meeting of August 29th (Agenda) and August 29th (Regular). 3. Upon the thorough review and recommendation of the Municipal Tax Collector, the Governing Body of the Township of Ewing does hereby resolve to authorize a REFUND in the amount of $998.68 for August 1, 2006 tax

quarter for property owner James & Kimberly Kay Shankle to James & Kimberly Kay Shankle, 14 Millard Terrace, Ewing, NJ 08638 for Block: 118.03, Lot: 39 also known as 14 Millard Terrace to refund overpayment. 4. A Resolution granting permission to Nicholas F. Knechel, 1048 Terrace Blvd., Ewing, NJ 08618 to join the West Trenton Volunteer Fire Company. 5. A Resolution authorizing a street closing on Beechwood Avenue for a block party sponsored by the Beechwood Avenue residents on September 23rd starting at 12:00 noon. 6. A Resolution authorizing a street closing on Tall Tree Court for a block party sponsored by the Tall Tree Court Civic Association on September 9th from 11:00 A.M. to 6:00 P.M. 7. A Resolution canceling the refund in the amount of $201.00 to homeowner Thomas D. McMath, 99 Browning Avenue, Ewing, NJ 08638 for building permit #20041121. Homeowner will be building as planned. 8. A Resolution authorizing a solicitors license to Thomas George Murison, (paint contractor) 2108 Burrough’s Mill Circle, Cherry Hill, NJ 08002 for house painting and power washing aluminum siding. The Consent Agenda was approved for consideration. ORDINANCE (S) FOR FIRST READING AND INTRODUCTION President Apai introduced a BOND ORDINANCE AUTHORIZING THE COMPLETION OF VARIOUS ROAD AND RELATED IMPROVEMENTS IN THE TOWNSHIP OF EWING, COUNTY OF MERCER, NEW JERSEY; APPROPRIATING THE SUM OF $600,000 THEREFORE; GENERAL OBLIGATION BONDS OR BOND ANTICIPATION NOTES OF THE TOWNSHIP OF EWING, COUNTY OF MERCER, NEW JERSEY, IN THE AGGREGATE PRINCIPAL AMOUNT OF UP TO $570,000 MAKING CERTAIN DETERMINATIONS AND COVENANTS; AND AUTHORIZING CERTAIN RELATED ACTIONS IN CONNECTION WITH THE FOREGOING. (2006) The ordinance was approved for consideration. President Apai introduced AN ORDINANCE AMENDING THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF EWING IN THE COUNTY OF MERCER AUTHORIZING THE TOWNSHIP OF EWING TO ENTER AN AGREEMENT OF SALE WITH EWING LOFTS AND STUDIOS, INC. FOR THE LEASE PURCHASE OF VARIOUS LANDS AND BUILDINGS IN THE TOWNSHIP OF EWING. (2006)

The ordinance was approved for consideration. NEW BUSINESS Council reviewed this portion of the agenda which included a resolution for Ewing Lofts and Studios, a resolution for the JCC purchase and a resolution approving participation with the Mercer County Improvement Authority for the lease purchase of capital equipment. All resolutions were approved for consideration. STATEMENTS AND COMMENTS FROM MEMBERS OF THE PUBLIC There were no comments. There being no further business, Ms. Wollert moved to adjourn the meeting, seconded by Mr. Summiel. The meeting was adjourned at 8:22 pm.
