UY, Petitioner. X - - - - - - - - - - - - - - - - - - - - - - -x PETITION FOR ISSUANCE OF THE CERTIFICATE OF EXCEPTION COMES NOW, the petitioner represented by its Governor through the undersigned counsel and unto this Honorable Commission, most respectfully alleges: 1. That the Petitioner is the local government duly represented by the incumbent Governor of the Province of Compostela Valley with tasks to implement the program/projects and the basic social services to the people of Compostela Valley, from Province wide down to the barangay level; 2.That petitioner Province of Compostela Valley spearheaded by the Provincial Engineer’s Office(PEO), Compostela Valley, has been implementing Infrastructure Projects , which some of it are to be realized on March 29,2019 to May 12,2019. Copy of the list of projects referred to is attached hereto marked as Annex “A”; 3. That petitioner Province of Compostela Valley spearheaded by the Provincial Agriculturist’s Office (PAgrO) has also special and continuing programs and 1 of 4

projects, to be implemented on March 29, 2019 to May 12, 2019. Copy of the list of projects referred to is hereto attached and marked as Annex “B”; 4. That Petitioner is aware that starting March 29,2019 up to May 12,2019, the release, disbursement and/or expenditure of public funds provided under Section 261(v) of the Omnibus Election Code, are prohibited pursuant COMELEC Resolution No. 10429 dated October 1,2018,but despite such prohibition, the Petitioner intends to continue implementing the Project for this year, CY 2019,since we considered such services as a normal functions and basic services for the barangay folks and to the public in general as exception to the requirements provided under Section 261 (v)-(2) of the Omnibus Election Code; 5. That since this program is done yearly and with prior notices to the concerned Barangays and Municipalities; the Petitioner is bound to implement the same according to its schedule; 6. That this Petition is not politically motivated but rather strengthened its commitment and to implement religiously and annually the basic functions of the Local Government Units, which is the construction of infrastructures for the benefit of the community and development of the area; 7. Lastly, a compact disc (CD) where the soft copy of this petition and all its attachments were stored and saved. The same shall also be sent to the Honorable Commission on Elections.

PRAYER WHEREFORE, premises considered, it is most respectfully prayed of this Honorable Commission that the Petition for issuance of the Certification of Exception of the Provincial Government of Compostela Valley’s Infrastructure Projects and other services which will be conducted during the above-mentioned period, be GRANTED.
