Terms & Conditions 2006 (Effective January to September 31st 2006)
Artwork All art for production must be supplied in electronic format. Non conforming artwork will be charged per hour at 80$(A)
Prices All orders are FOB our factory Ayers Cliff, Quebec, Canada. Taxes, duties & transport additional.
New Accounts & Payment Terms All web transactions are paid at time of order using paysystems.com transactional (fully secure) payment server. For non-web transactions - a credit application is required from ALL new accounts, as well as 25% deposit for first order. The balance is C.O.D. Terms applicable to established customers are net 30 days.
Standard Colour Check List Gold (PMS#871), Silver (PMS#877), Black, White, Red (PMS#186), Maroon (PMS#194), Violet (PMS#2685), Process Blue, Reflex Blue, Navy Blue (PMS#282), Teal (PMS#322), Light Green (PMS#348), Dark Green (PMS#350), Yellow (PMS#116). All colours vary with the printing process (i.e., silkscreen, pad print), the colour of the material being printed on, as well as the type of surface (shiny or matte finish). PMS Numbers are indicated for reference only. They are approximate as PMS Colours are based upon process printing on white substrate.
Colour Matching We will do a PMS colour match at a charge of $35.00 (G). The best matches will be achieved when printing on a white product. We do not recommend colour matching on coloured surfaces.
Ink, Copy & Product Colour Change For ink changes within an order add $20.00 (G) per colour change. For copy changes within an order add $40.00 (G) per copy change. The minimum quantity required for a colour / copy change is 50% of the lowest catalogue quantity. Product colour changes are available for minimum catalogue quantities only.
Proofs $6.25 (G) for fax or paper proof in addition to all other charges. $15.00 (G) per imprint for product proofs plus art, screen, set-up cost of product and shipping costs. Revision of proofs will be re-charged as a new proof and include additional art charges. Note: Total responsibility for design and imprint lies with the buyer when a proof is approved or if no proof is requested.

Speculative Custom Sample $75.00 (G) per colour/location plus product cost and shipping. Speculative samples are 50% rebate able with a resulting order. Stock Sample Request $20.00 (G) including shipping anywhere in North America. Any where in the world $50.00 (G)
Over / Under Runs / Exact Quantities Due to the nature of our manufacturing process, we reserve the right to under or over ship an order by 5%. If you require exact quantities, please add $25.00 (G). Exact quantities are available on one (1) colour orders that do not exceed 1,000 units.
Less Than Minimum There will be a charge of $70.00 (G) for orders less than the catalogue minimum. The absolute minimum order is 50% of the lowest catalogue quantity. Minimum quantity is 1,000 units.
Non-Imprinted Products If your order does not require an imprint, it will be billed at the end quantity price. Minimum catalogue quantities apply. Product will be shipped bulk. No returns accepted. Please allow 24 hours for credit established accounts.
Repeat Orders Furnish our original acknowledgement number as well as your purchase order number. No art or screen charges on exact repeat orders. Files and artwork will be saved for 2 years.
Rush Orders Rush orders are available but must be authorized by the factory. A rush charge may apply and air shipments must be authorized. A 15% surcharge will apply.
Patents Products noted as The Original Bottle Cap Lure Company Ltd. Patent or Patent Pending notifies the industry that The Original Bottle Cap Lure Company Ltd. has one or more U.S. patents applied for and pending on the noted item. The Original Bottle Cap Lure Company Ltd. is the designer and developer of these products and will vigorously defend our patents.

Trademark Usage Artwork, designs, logos and trademarks imprinted on products in this catalogue have been reproduced only as an example of the quality of imprints available from The Original Bottle Cap Lure Company Ltd. They are not intended to represent or constitute an endorsement of The Original Bottle Cap Lure Company Ltd. or its products by any other company. All copy or other material submitted by the customer for use by factory in producing the items ordered will be accepted by factory as being submitted in full compliance with all applicable laws regarding trademark, service mark, copyright, right of privacy, patent contractual limitations or similar protection. Right To Promote We reserve the right to use all products in our advertising and displays, unless otherwise specified in writing at the time of order. Production Lead Time Orders under 10,000 units – from date of pre-production sample approval - unless otherwise specified and when our production schedule permits - standard production time is ten (10) working days or sooner for credit established accounts. Order processing is dependent on prior approval by our credit department.

Orders will be shipped ground, via the customer’s carrier unless otherwise specified. Any shipping service will require your carrier’s account number. All 2 day service or air shipments will be shipped via the customer’s carrier unless otherwise specified. Any shipping service will require your carrier’s account number Goods lost or damaged after leaving our facilities are the responsibility of the customer’ shipper. For drop shipments or split shipments add $20.00 (G) per each additional address.
Returns & Cancellations All claims must be submitted in writing within 10 days of receipt of goods. No merchandise will be accepted without prior authorization and a return number issued by the factory. To cancel an order before production requires a $50.00 (G) cancellation fee. To cancel during production, order will be billed for cost of labour and materials, in addition to cancellation fee. All cancellations must be authorized by factory.
