Application U/s 5 of Limitation Act, 1908.

Respectfully Sheweth: 1.

That the contents of main petition may please be treated as part and parcel of this application.

2.

That the respondents submitted the comments in constitutional petition and assured this Hon’ble Court that there is no further enlistment for the non-qualified professionals, after the cut date i.e. 31.12.89. It was also contended by the respondents that no Diploma Holder could work as Draftsman.

3.

That the assurance and contention of the respondents was not true; and on the exploration, the applicant found a letter from the respondents allowing the applicant and others to work as Draftsman as ordinance is not applicable in this respect.

4.

That furthermore the respondents enlisted more professionals in the category of applicant and a Directory in the year 1990 was also published including the names of professionals enlisted after the cut date. It is pertinent to point out that

another Directory in the year 1992 was also compiled by the respondents after further enlistment, which is not available for the time being. 5.

That both these documents were not in the possession of applicant within the period allowed for the review of judgment under the Limitation Act e.g. 20 days.

That the applicant received these documents on 30.11.02 and he is filing this review without any further delay.

7.

That the valuable rights of the applicant are attached with the matter and the applicant by no way can be held responsible for delay if any. It is therefore, respectfully prayed that the delay, if any, for the filing of review petition, may please be condoned in the interest of justice. Any other relief, which may be deemed fit and proper, may also please be granted. Humble Applicant,
