Wehby, MD, Chair) 16 17 18Whereas, The issue of reforming our health care system is a central theme of President 19Obama’s administration and among leaders in the Congress of the Untied States; and 20 21Whereas, Significant reforms have been enacted at a rapid pace; and 22 23Whereas, Physicians provide medical care which is a professional service based on the 24physician-patient relationship; and 25 26Whereas, The right of the physician and the patient to enter into a private contractual 27relationship for medical services is the sine qua non of the private practice of medicine, and 28 29Whereas, Our AMA has formulated well-founded policy of pluralism, freedom of enterprise and 30the professional values that underpin the private practice of medicine as a profession; and 31 32Whereas, There is great uncertainty as to the scope of reform that will be enacted and the 33degree to which these reforms will impact the private practice of medicine making it imperative 34that AMA immediately focus on fundamental free-market tenets that will ensure the continuation 35of the private practice of medicine including the right to privately contract with patients, the right 36to balance bill, or not, pursuant to a private contract with the patient and the ability of physicians 37to negotiate equitable contracts with health plans and insurers; and 38 39Whereas, The physicians of America face a crucial moment in the history of medicine: a time 40which requires clarity of purpose and a highly focused agenda; therefore be it, 41 42RESOLVED, That our AMA Board of Trustees immediately make as its highest priority: 43 441. The enactment of federal legislation that ensures and protects the fundamental right of 45physicians to privately contract with patients, without penalties for doing so and regardless of 46payer within the framework of free market principles with the goal of accomplishing this by 2010; 47and 48 492. The restoration of fairness to the current health care marketplace through changes in statutes 50and regulations so that physicians are able to negotiate (individually and as defined groups) fair 51contracts with private sector and public sector heath plans.
