Dear Mr. Mimkes: I am writing to you in regards to the ongoing matter regarding issues raised by the Coalition against BAYER Dangers (Germany) (“CBG”) and the Global Compact Participant of Bayer AG. Thank you for your patience in this matter. We understand from your letter from 25 August 2009 that you were not satisfied with the letter from Bayer. First, I would like to reiterate that the Global Compact, under its Integrity Measures “is not designed, nor does it have the mandate or resources to monitor or measure participants’ performance.” Rather the Integrity Measures are designed to facilitate communication between the parties and if need be, the nature of those communications. As a result of this impasse, the Global Compact Office has asked if Bayer wishes to respond to CBG. If this is the case, we request that we be copied in any correspondence. Alternatively, we may exercise our discretion – as provided for in the Integrity Measures – "to ask the relevant country/regional Global Compact network... to assist in this matter." Given that both parties in this instance are based in Germany, we feel that the Local Network in Germany will be in a better position to handle the issues in a manner that will be mutually beneficial to all parties. Note, the Global Compact Network, operating under our Integrity Measures, may defer to the National Contact Point for the OECD Guidelines on Multinational Enterprises, an entity which has substantial and robust capabilities in handling disputes.
