Dear Mr. Kell, With regard to the UN Global Compact’s Integrity Measures we would like to keep you informed about our company’s actions taken to address the situation which is the subject matter of the allegation: our company’s approach in handling the accident at the Bayer CropScience plant in Institute, West Virginia. As I stated in my previous letter Health, Safety, Environment and Quality (HSEQ) are highly important issues for the Bayer Group. This is why we have immediately taken measures to prevent such an accident to happen again in future. The authorities involved in the investigations into the causes of the accident have been fully supported by Bayer CropScience. Our Company also undertook its own investigation and has initiated steps to further improve occupational safety and communication in emergencies. Accordingly, we have already implemented a number of changes. Furthermore, Bayer CropScience yesterday announced an investment of $25 million for further enhancing operational safety at its Institute site. As part of these plans, our company will reduce methyl isocyanate (MIC) storage by 80 percent. Beyond the changes just announced, Bayer CropScience will continue to evaluate the feasibility of further measures, which may also include the use of alternative process technologies. The goal of all these measures, which have been developed and implemented in close cooperation with the authorities, is to ensure the safety of employees and neighbors and limit impact on the environment. In going forward, our company will also continue its dialogue and close cooperation with the community and governmental agencies involved.
