1. Purpose. This publication sets forth format and procedures to govern the Transferring between Major Commands (MACOM) of Army and Air Division, and the Civil Military Affairs Brigade. 2. Application a. This publication is directive in nature and applies to all members of the New York Guard. b. These procedures will be followed, except when, in the judgment of the commander, exceptional circumstances dictate otherwise. 3. Scope. This publication describes and establishes the policies and procedures for active New York Guard members to apply for permanent transfer between components.

NYGD 1300 CHAPTER I POLICY

New York Guard Members requesting MACOM transfers are subject to the following policies related to such transfer. a. This is a one-time transfer only. b. Present grade level and accrued official time in grade remains in effect. c. Individual must fill an approved TDA/UMD position at appropriate grade level. No overgrade filling of positions will be allowed. d. Member may be required to remain in their current grade for a minimum of one year from the time of transfer. e. The receiving MACOM Commander may opt to allow the transferring individual their time in grade for establishing future promotions.

NYGD 1300 CHAPTER II RESPONSIBILITIES

1. The J1, Deputy Chief of Staff for Personnel will; a. Provide the gaining MACOM’s Membership Board with copies of personal information currently include in the individuals Military Personnel Records Jacket, from the Headquarters New York Guard. This will include application for initial NYG membership, current copies of biography, any and all training records, evaluation reports, physicals, etc. b. Issue official transfer orders, regarding effective date of transfer, duty assignment, and pay grade level and MACOM approved date of rank. 2. Commanders of New York Guard Components. Commanders of the Army Division, Air Division and Civil Military Affairs Brigade will; a. Losing Command. 1) Upon receiving a transfer request, the losing MACOM chain of command will concur or non-concur with the request, which must be accomplished within thirty (30) days of receipt of request. 2) Concurrence will be forwarded to the gaining MACOM Commander, with copy furnished Headquarters NYG, ATTN: NYSG-J1. 3) Non-concurrence will be returned to the individual with reason for non-concurrence and recommended corrective actions, with copy furnished Headquarters NYG, ATTN: NYSG-J1. b. Gaining Command. 1) Upon receiving a transfer request will convene a Membership Board to review the individual request which must be accomplished within sixty- (60) days of receipt of request. 2) After reviewing the minutes of the Membership Board, the MACOM Commander will make the final decision stating the approval and/or disapproval of the transfer. 3) The gaining MACOM Commander will advise the NYG member, losing MACOM Commander and the Headquarters NYG, ATTN: NYSG-J1 of the results. c. This directive will be followed, except when, in the judgment of the Commander New York Guard, exceptional circumstances dictate otherwise. Conflicts will be resolved through recommended changes to this Directive. Commanders will not publish regulations or instructions that conflict with this Directive. II-1

3. Individual Members of the NYG, will; a. An individual requesting transfer must make formal written request, through their chain of command, in accordance with this directive. b. If approved, the individual will have approximately six (6) months from the official date of transfer to comply with receiving division uniform requirements, i.e. service, dress, and BDU with proper insignias, furthermore any qualification badges awarded by a competent authority must comply with the receiving unit uniform standards.

NYGD 1300 CHAPTER III PROCEDURES

1. Submittal of Request. The requesting NYG member must initiate a written request for transfer between Major Commands (MACOM). This request must be forwarded through their chain of command to the Commander of the gaining MACOM. Copies of this request must be provided to Headquarters NYG, ATTN: NYSG-J1. 2. Actions on Receipt of Request. a. Losing MACOM. The Commanders in the chain of command will concur and forward, or non-concur and return request, with copy furnished Headquarters NYG, ATTN: NYSG-J1. Non-concurrence must be explained, such as identification of an incomplete mission tasking and provide guidance to rectify the non-concurrence. b. Gaining MACOM. The Commander of the gaining MACOM, upon receipt of a transfer request will appoint a Membership Board to review the individual’s request. This must be accomplished within sixty (60) days of receipt of request. 3. Personal Information. Headquarters NYG will provide the gaining MACOM with copies of personal information currently on file in the individuals Military Personnel Records Jacket. This will include application for initial NYG membership, current copies of biography, any and all training records, evaluation reports, physicals, etc. 4. Membership Boards. The Membership Board will review the individual’s records and determine if they are qualified for a position in the Command. An appropriate position in the Command’s approved TDA/UMD will be identified. TDA/UMD positions may not be filled overgrade. Any other additional documentation required may be requested directly from the requesting individual. 5. Transfer Recommendation. The Membership Board will make recommendation to the Commander on the transfer, and if recommended identify the position of assignment. 6. Commander’s Approval. The MACOM Commander will concur or non-concur with the Membership Board’s recommendation. 7. Formal Notification. The gaining MACOM Commander will advise the individual, through the losing MACOM chain of command, and Headquarters NYG, ATTN: NYSG-J1, of the decision to accept or not accept the transfer. If accepted, the notification will include the duty assignment. III-1

8. Transfer Orders. Upon notification of a transfer acceptance, Headquarters NYG will prepare transfer orders. Copies will be provided to the transferring individual, gaining and losing MACOMs, and the individual’s Military Personnel Records Jacket. 9. Uniform Compliance. The transferred individual will have approximately six (6) months from the official date of transfer to comply with the gaining MACOM’s uniform requirements, i.e. service, dress, and BDU with proper insignias, furthermore any qualification badges awarded by a competent authority must also be in compliance.
