TERMS OF AGREEMENT Payment Method: Term 1: Prior to booking a date 1/2 of the negotiated fee is to be paid at least 4 weeks in advance and non-refundable upon cancellations excluding cancellations made by Never Nervous Ent, and mishaps beyond our control and/or at the fault of the promoter including cancellations. (Please note for all bookings cash, money orders or wire tranfers (western union) are accepted for the deposit and cash is the only available payment option remaining for the balance. Term 2: The remaining amount of the negotiated fee is to be paid upon arrival at the venue before any services are rendered. Term 3: For each venue the minimum capacity of occupancies in which Artist will perform is 50% of the venue size. Performance there on after is at the discretion of the Artist and if the amount in attendance within the venue/event is below 50% in attendance and there will be NO REFUND of the deposit and/or the negotiated balance. Accommodations: Term 4: (if applicable to Out-of-State/Country venues) the promoter will provide all accommodations including Travel and Lodging Expenses. A: Air Fare (if applicable): Promoter must provide round trip airfare for Artist and plus 2 for management to accompany. Promoter must also provide all applicable expenses if any in conjunction with flight. Meaning excess weight cost for equipment needed for performance (ex. TERMS OF AGREEMENT Please note Artist and as well as management will not be held accountable for any actions, which result in delays and/or cancellations due to the fault of the provided transportation by the general promoter, event coordinator or colleges. Term 5: All information in regards to the performance venue and event shall be submitted before any final negotiations are made. (DJ /Artist) - TECHNICAL RIDER
SECTION 1.
PROMOTER ATTENDANCE AND RESPONSIBILITIES.
Promoter agrees to provide at his/her own expense, a representative capable of making and carrying out any decisions pertaining to the engagement on the day of the Artist Entourage's arrival, through their departure date. This promoter’s representative must have all relevant documents and information pertaining to the engagement on his/her person at the time of introduction. Promoter's representative will remain accessible for the duration of the stay.Artist’s Production / Manager will make all decisions pertaining to the show.B. Promoter representative will provide Artist / Manager with telephone numbers where promoter representative may be reached at home, business, on cellular or pager at time of artist arrival threw duration of stay until departure.C. Venue shall provide any properties, staging and show production effects relevant to Artist’s performance.D. Promoter representative will inform the Artist/Tour Manager of any and all peculiarities with local building rules, union and non-union work regulations and compensations, and any items, which affect the cost and the integrity of the show. Any financial obligation regarding the latter shall be the responsibility of the promoter. SECTION 2.
STAGE & EQUIPMENT..
Stage must be structurally safe and sound with no uneven edges or corners. The stage area must comfortably accommodate all Artist personnel. DJ equipment and staging must be able to sustain rigorous movement2 Techinques 1200 Turntables 3 Channel Mixer 2 Cordless Mics & 1 Mic StandPA System / Monitors & Professional Sound Engineer SECTION 3.
VENUE PREPARATION.
Promoter shall provide Load-in/Load-out crew for all Artist band personnel equipment.C. Venue/Promoter to provide professional/adequate Stage lighting system, with Venue Lighting Designer/operator, whom shall be available for both sound check and Artist performance.
SECTION 4.
DRESSING ROOMS / RESERVED VENUE SECTION.
Light catering and refreshments to be provided by promoter: - 10 bottles of cold Spring Water / 1 Bottle of Hennessy and/or 1 Bottle of Patron Silver - 1 Bottle of Moet Chandon Rose w/ 1 Gallon of Fresh Orange Juice - 1 2liter bottle of Coca-Cola soda and/or 1 gallon of Cranberry juice - Fresh Fruit Basket - 5/10 Fresh *New* Clean White towels or Hand Towels
SECTION 5. SECURITY Adequate Artist Security to be provided by promoter for Artist Entourage on arrival at venue and where necessary for the duration of their stay through departure. Dressing rooms to be covered by Security at all times Artist Personnel are present in venue, including show time. 3 SECTION 6. PASSES Minimum (10) Show access passes provided by the Venue or Promoter to Artist Production SECTION 7. CATERING A. Evening meal to provided by Promoter for Artist & Management Personnel between sound check and ShowTime. If the total stay of time exceeds (1) day promoter is responsible for 1 meal a day per day. Menu or Restaurant to be mutually agreed with Artist Production/Tour Manager. SECTION 8. HOTEL ACCOMODATION & GROUND TRANSPORTATION A.Equivalent of 3-5 star accommodations to be provided by Promoter. Adequate single KING Bedrooms for Artist and management (3 total). B. Promoter agrees to pay for one passenger van/truck to accommodate at least 4 people for transportation between airport, hotel and venue, or for transport wherever Artist Representative deems necessary. SECTION 9.
MERCHANDISING
Artist shall have the right but not the obligation to sell souvenir items (ex. Tshirts, Music CD’s etc.) And other merchandise and to retain 100% of the receipts. Artist reserves the right to confiscate part of all of any unauthorized “Bootleg” Merchandise being sold in or around the venue. SECTION 10.
RECORDING & BROADCAST
No portion of the performance may be filmed; video taped, broadcast, recorded or mechanically reproduced without express written consent from the Artist’s Management. If any such unauthorized recording is discovered, Artist shall have the right to withhold performance without prejudice to his right hereunder. If any rights to television or radio or Internet transmission are included in the Agreement, immediately after the broadcast the master tapes are to be turned over to the artist who shall be the sole owner thereof with restriction. SECTION 11. COMPLIMENTARY TICKETS Purchaser shall provide Artist with (10) complimentary tickets on the day of the performance 5 hours prior to door opening. SECTION 12. FEES Artist will not be responsible for any guild fee, music royalty charges, union dues, local taxes, airport taxes and none shall be deducted from the agreed
contract price. All such charges will solely be consumed by the promoter (fees, dues, or taxes etc..) Any part of this rider that is not adhered to is considered to be a breach of contract, thereby putting performance in jeopardy and subjecting performance to cancellation with Purchaser liable for all expenses and any monies due to Artist that would constitute a sold out show. This agreement may not be changed, modified or altered in any manner whatsoever except by an instrument in writing signed by all the parties.
