Writ in the Nature of Discovery Please mail to the Borrower, the following Certified and Verified Official Copies of Loan Related Documents; or schedule a Meeting and opportunity for the Borrower or her / his CPA to make a Physical Inspection of the following Documents and enable the Borrower or CPA to verify and Witness the same. This is a Lawful Demand and Request, under the ‘Rule of Discovery’, and forwarded to your Agency and Agents (Name of Entity and / or Representative / s). A Meeting shall be set and concluded to effectuate the above stated Physical Examination and Witnessing within Twenty (20) Days of the Receipt of this ‘Notice of Discovery’. Produce the following Documents with all related and associated Instruments: 1. Produce the ‘Original Promissory Note’ (front and back) associated with the Loan from your Agency / Entity / Persons to the Borrower. 2. Produce any ‘Allonge’, ‘Bill of Exchange’, and / or ‘Promissory Note’ (front and back) complete with any ‘Affixations’ or ‘Allocations’ attached to the ‘Borrower Promissory Note’ for ‘Endorsements’. 3. Produce all Bookkeeping Journal entries associated with the Loan to the Borrower. 4. Produce the ‘Deed of Trust’ associated with the Loan to the Borrower. 5. Produce the ‘Insurance Policy’ in place on the Borrower’s ‘Promissory Note’ associated with the Loan. 6. Produce all ‘Call Reports’ and related ‘Notes’ made for the period covering the Loan. 7. Produce the ‘Deposit Slip’ for the Deposit of the Borrower’s ‘Promissory Note’ associated with the Loan. 8. Produce the ‘Original Order’ authorizing the withdrawal of funds from the Borrower’s ‘Promissory Note’ Deposit Account. 9. Produce the ‘Account Number’ from which the money came to fund the ‘Check’ given to the ‘Borrower’. 10. Produce ‘Verification’ that the Borrower’s ‘Promissory Note’ was a ‘Gift’ to the ‘Lender’ from the Borrower. 11. Produce the ‘Name’ and the ‘Address’ of the current ‘Holder’ of the Borrower’s ‘Promissory Note’. 12. Produce the ‘Name’ and ‘Address’ of the ‘Lender’s CPA and Auditor’, for the period covering the Execution. This Writ is the Borrower’s honorable and ‘Good Faith’ attempt to clear up any insensate misrepresentations or confusion, concerning resolutions in this matter, before taking any further actions. I am prepared to meet with you, or your authorized representative, forthwith. I will have Council and Witness present, for the Record. A failure of your company or loan officer (the fore-mentioned Entity or Representatives) to ‘Respond’ to this lawful request within the allotted twenty (20) days of Receipt of this ‘Writ In The Nature of Discovery’ will be considered as an affirmation of disingenuous intent, and the said failure of Response to the twelve (12) above - noted issues, will be deemed a ‘Dishonor’ of this ‘Notice and Demand for Disclosure’.
