Will of Charles Beall, Husband of Tabitha Beall (daughter of Joseph Beall) In the name of God Amen I Charles Beall of Frederick County and State of Maryland bein gin perfect health of body and of sound and disposing mind memory and understanding considering the certainty of death and the uncertainty of the time thereof being desirous of setting my worldly affairs do therefore make and publish this my last will and testament in manor and form following that is to say – First I commit my soul into the hands of the almighty and my body to the earth to be decently buried at the discretion of my executrix herein after named -- I give and divise to my dearly beloved wife Tabitha Beall the plantation whereon I now live with all the land that I claim adjoining thereto during the term of her natural life. Item I give and bequeath to my dearly beloved wife Tabitha Beall during her natural life the three following Negroes (to wit) Gambia Jacob and Bab. I also give and bequeath to my said wife my old grey mair and young colt and one equal third part of all my personal estate other than Negroes which said devise and bequest to my wife are intended to be in leu of her claim of dower and ____ of my personal estate. Item I give and bequeath to my daughter Prissilla one negro woman named Flora and her daughter Milla to her and her assigns – Item I give and bequeath to my daughter Susannah one negro woman named Hannah and one Mulatto girl named Poll to her and her assigns forever – Item I give and bequeath to my son Assa one negro lad named John and one Mulatto girl named Calo to him and his assigns forever – Item I give and bequeath to my daughter Betsay one negro lad named Len and one negro child named Bitt to her and her assigns for ever – Item I give and bequeath to my daughter Bysey one negro girl named Rachel and one negro girl named Luie to her and her assigns for ever – Item I give and bequeath to my daughter Sarah one negro girl named Dilla and one negro boy named __ to her and her assigns forever – Item I will and devise and direct that all my land in Montgomery County should be set by my executrix herein after named and after paying my debts with the money arising from the sale thereof I will and direct that if any of my children should be so unfortunate as to loose one or both of their negroes by death or any other unavoidable accident or if I should sell any one or

more of the negroes above willed that such negro or negroes be replaced or made good out of the money arising from the sale of aforesaid land at the direction of my executrix herein after named and after that land and direct that the ballance that may remain ma y be laid out in the back lands of Virginia and the lands equally divided among my children herein before mentioned or such of them as shall survive at that time or that the ballance or residue remaining after my just debts is paid or making good any loss or sale as before mentioned shall be equally divided among my children and each part put out on interest of that shall in the judgment of my executrix be more for the advantage of my children than the purchase of back lands – Item I devise and direct that the plantation whereon I now live shall after the death of my wife be sold by my trustees herein after named for that purpose or the survivor of them and that the money arising from the sale thereof shall be equally divided among my children Prissilla, Susannah, Assa, Betsey, Bysey, and Sarah and their representatives in case of the death of any of them and I do hereby constitute and appoint my esteemed friends Hardage Lane of Virginia and Alexander Callill with Montgomery County and State of Maryland or the survivor of them to be trustees and trustee for selling the plantation whereon I now live after the death of my wife and do request them to except the same – Item I give and bequeath to my children Prissilla Susannah Assa, Betsay, Bysey and Sarah and their heirs equally to be divided between them all the rest and residue of my estate both real and personal. I also give and bequeath to them after the death of my wife the three following negroes Gambia, Bab, and Jacob, herein before bequeathed to my wife for and during the term of her natural life to be sold and the money equally divided among them and their heirs – and lastly I do hereby constitute and appoint my dear wife to be sole executrix of this my last will and testament revoking and annulling all former wills by me heretofore made ratifying and confirming this and no other to be my last will and testament in testimony whereof I have hereunto set my hand and affixed my seal this twenty third day of October Anne Domini one thousand seven hundred and eighty three Signed Sealed published and delivered by the testator as and for his last will and testament in the presence of us who have in his presence and in the presence of each other and at his request subscribed our names hereto as witnesses Ninian Beall, Joseph Beall, James Kendall Frederick County March 5 1790 Then came Tabitha Beall and made oath on the Holy Evangels of almighty God that the afore

Murdock Frederick County March 5, 1790 Then came Joseph Beall and James Kindall two o f the subscribing witnesses to the aforegoing last will and testament of Charles Beall late of Frederick County deceased and made oath on the holy evangels of almighty God that they did see the testator therein named sign and seal this will that they heard him publish pronounce and declare the same to be his last will and testament that at the time of his do doing he was to the best of their apprehensions of a sound and disposing mind memory and understanding that they respectively subscribed their names as witnesses to this will in the presence and at the request of the testator and that they did also see Ninean Beall the other subscribing witness subscribe his name as a witness thereto in the presence and at the request of the testator and all in the presence of each other. - Geo.
