Subject: Right to Information Application - Seeking replies under section 7 (1) and Section 8(2) of RTI ACT 2005 Section 8(2) - Notwithstanding anything in the Official Secrets Act, 1923 nor any of the exemptions permissible in accordance with sub-section (1), a public authority may allow access to information, if public interest in disclosure outweighs the harm to the protected interests. Here a doctor is supposed to be life saviour but his identity is unknown to Medical Council of India and it is mandatory for genuine doctors to be registered with Medical Council of India wide Section 24 of IMC Act 1956. People using fake credentials in medicine are a serious threat to the public.
Section 7 (1) Provided that where the information sought for concerns the life or liberty of a person, the same shall be provided within forty-eight hours of the receipt of the request. Here a person’s name does not exist in IMR database of MCI. Respected Sir, This application on plain paper is of serious matter in which victims are new born babies and children as the matter deals with doctor with fake multiple MBBS and multiple identities. One such identity with which legal Indian passport exists with this name, is unknown to Medical Council of India and yet he is registered with Indian Academy of Pediatrics. Also reply by Medical Council of India in response to my RTI to Honourable Supreme Court dated 24th Jan 2007 below says – 4. From Medical Council of India (MCI), I want to know how many fake degrees an individual can keep and still practice medicine and surgery in public within framework of constitution of India ? Also is there any special Act that a person with fake degree manages to practice medicine in public ? MCI Reply to The CPIO, Supreme Court of India is -

What Information I want with reference to above context ? For Honourable Supreme Court 1. Does Honourable Supreme Court of India has some information which empowers Indian Academy of Pediatrics (IAP) to register/promote doctors/Pediatricians who are unknown to Medical Council of India. Is Indian Academy of Pediatrics running a parallel institution similar to MCI under the framework of constitution of India for registering doctors unknown to Medical Council of India ? 2. Under which Act/Rule of Indian Constitution does Indian Academy of Pediatricians registers Pediatricians and promotes them who are unknown to Medical Council of India ? 3. In which year did IAP attained equivalent status like that of Medical Council of India ? For Indian Academy of Pediatrics (IAP), Kailas Darshan, Kennedy Bridge, Mumbai 400 007 4. Registration date with IAP and photocopy of educational qualifications (Credential Details) of Dr S Prasad Vankayalapti, resident of Banjara Hills, Hyderabad who is registered with Indian Academy of Pediatrics but unknown to Medical Council of India. Credential details should include – copy of MBBS degree, other medical degrees/diploma, copy of registration form of IAP for membership no. L /1999/V-296 ( ) of Dr S Prasad Vankayalapati, existing in records of Indian Academy of Pediatrics in Mumbai. Credential details of a doctor are public information and not personal information. It does not require to take any consent from third party in this matter under Section 8(2) of the RTI Act as its public information and not personal information. 5. Reasons if this application is not accepted under section 7(i) of RTI Act 2005 or Section 8(2) of RTI Act 2005. 6. What type of membership does Dr S PRASAD VANKAYALAPATI holds ? a) Ordinary b) Life, c) Associate, d) Associate life e) Affiliate f) Affiliate life. 7. Who is the IAP president for New Delhi and what’s the procedure to contact him/her ? Kindly provide telephone number, mobile number to contact him/her ? 8. IAP writes its aims as – To serve as advocates for children and adolescents and help their families with reference to attainment of optimal, physical, mental, psychological and social health of children and adolescents. To consider and express its views on all questions affecting child health in India and to study, suggest, criticize or otherwise, advise or take part in the framing of laws affecting the science and practice of pediatrics. Will IAP help in exposing International health fraud effecting new born babies and children ?
