yehwadong, Seoul — Philippine Overseas Labor Office (POLO) Attaché Atty. Delmer Cruz has sought suggestions and recommendations from the Filipino EPS Workers Association (FEWA), led by its President Sofonias Paragsa, last Aug. 17 with regard to the renegotiation of the Memorandum of Understanding (MOU) between Ministry of Labor (MOL) of Korea and the Department of Labor and Employment (DOLE) of the Philippines on the sending and receiving of workers under the Employment Permit System. Attaché Cruz informed FEWA about the MOU that is set to be inked anew before its reimplementation in October. It has been observed that the said MOU, on its current stage, needs consultation with the EPS workers who have personal work experiences particularly in signing documents like the standard labor contract. Also, he shared that FEWA members could give in some inputs which are significant since they have been exposed to the current labor (turn to page 2)

yehwadong Seoul - As the ratification for Social Security Agreement between the Republic of the Philippines and Republic of Korea is scheduled by the Philippine Senate, the Filipino EPS Workers Association (FEWA) started its plan to revive the signature campaign against the transfer of Lump-sum Refund of all covered Filipino Overseas Workers under the National Pension Scheme (NPS) in South Korea to the Philippine Social Security System (SSS) on August 24.

The said agreement did not specify the transfer of the NPS Lump-sum Refund to the SSS not until recently, the NPS Head Office representative in Seoul has confirmed, thru a phone interview to SULYAPINOY, that once the Bilateral Social Security Agreement is ratified by the Philippine Senate, all OFWs covered by the NPS monthly contribution can no longer avail the Lump-sum Refund benefits after their sojourn period. yeonggi-do, South Korea - The Ministry of Labor (MOL), through a phone interview with the SULYAPINOY, on August 4 clarified that the revised bill on Foreign Workers Employment Act is not yet implemented. “The revised bill is still to be ratified by the unicameral legislature through a National Assembly which is scheduled to be opened on September this year. As of now, we cannot say when is the exact implementation date”, the MOL worker’s hotline representative said. According to preliminary announcement released by the MOL on July 8 through its website, the amendment on Foreign Workers Employment Act aims to ensure the prompt import of needed foreign workforce and to strengthen the Korean government support for foreign workers. The revised bill allowed the newly hired foreign workers for small and medium-sized enterprises under the Employment Permit System (EPS) to stay in Korea for five consecutive years without returning to their respective native countries. However, stipulation on length of sojourn according to Foreign Workers Employment Act, incorporation of basic Korean labor laws to the Preliminary Departure Orientation Service (PDOS) for newly hired and rehired workers under EPS, exemptions of nonrehired workers from taking the Korean Language Test (KLT) when he is willing to apply back to Korea, voluntary leavers to be on the “priority list” of the Philippine Embassy, two-year validity of the job seeker roster, return-cost insurance and VISA processing fees to be paid by the employer were some of the suggestions to be renegotiated. More so, Attaché Cruz informed his recommendation of the attachment of the standard labor contract to the MOU upon signing of the two parties. He believed that the labor contract is also subject for further review. Sulyap’ Managing Editor Dondave Jabay participated in by sharing some recommendations and labor laws for foreign workers. While, Paragsa facilitated the consultation as he pointed out the collective labor problems of the EPS workers. Some of the suggestions for the labor contract are as follows: specification on the nature of work and type of business, complete daily meals, conducive accommodation or dormitory, inclusion of the monthly payslip and yearly home vacation for the employer to be well-informed and abide the said labor contract. Attaché Cruz shared about the suggestions to be included in the renegotiation, otherwise, a negotiating team is needed to reconcile until it is signed by the Department of Overseas Labor and Employment (DOLE) of the Philippines and the Ministry of Labor (MOL) of South Korea. Currently, FEWA is the largest group of EPS workers while its officers and members volunteer to help fellow workers who seek advice on some labor-related problems.

Part of the amendment is the improvement of the hiring process. Korean employers can now hire foreign workers according to their needs. Foreign job seekers may be assessed through direct interviews and the results will be recorded in the roster of job seekers. In addition, the revised bill also provided stronger support to foreign workers. “If foreign workers cannot work for reasons not attributable to their faults; like the cases of industrial accidents or diseases, the existing two months job seeking period permitted for a change of workplaces will be put off until after such reasons no longer exist”, the MOL explained.

Delmer Cruz to conduct consultations and consider some suggestions for the renegotiation of the MOU from different Filipino organizations like the Filipino EPS Workers association (FEWA) is highly commendable for it has given the EPS workers the privilege to discuss the current problems, get involved and hit immediate possible solutions and recommendations. On the other hand, the determination of the said labor agency to renegotiate the MOU with the solicited amendments needs immediate action, constant monitoring and full support from various sectors to curb the perennial issues and work-related problems. Also, as the number of EPS workers increases, so do labor-related issues and concerns which challenge POLO to exert extra effort in providing vital services and urgent solutions to the problems.

Delmer Cruz has informed FEWA recently of the said agreement which was already ratified by the National Assembly of South Korea in December of 2006. For the Philippines, the signed agreement was also received by the Senate on April 28, 2008 and was referred to the Commission on Foreign Relations the following day by which the committee is currently chaired by Sen. Miriam Santiago. FEWA President Sofonias “Chabok” Paragsa has strongly opposed the NPS statement. “The SSS plan of getting our NPS Lump-sum Refund is really unfair and inhuman. The Philippine government should realize how tough our life in South Korea working in 3D Jobs (Difficult, Dangerous, and Dirty) category and how important is the NPS contribution Lump-

sum Refund for the reestablishment of our economic condition upon returning back home. That money is the only savings that most workers can bring after their contract as they regularly send their monthly income to their respective families in the Philippines,” Paragsa commented. “We are preparing the draft petition letter to be sent to the Philippine Senate together with the collected signatures requesting the senate to ensure that our NPS Lump-sum Refund benefits should be continuously granted through the ‘Principle of Reciprocity’. We are asking the full support of all Filipino organizations in South Korea to disseminate this signature campaign information as we show unity and express our strong call for our respected senators to reject the SSS plan of absorbing our own money,” Paragsa added. This issue was triggered two-years ago when the Philippines and South Korea signed a bilateral agreement providing for social security protection and benefits to their respective citizens in either country. The signing ceremony was held last December 16, 2005 at the Ceremonial Hall of Malacañang Palace, with Philippine Foreign Affairs Secretary Alberto G. Romulo and Minister Ban Ki-Moon of the Korean Ministry of Foreign Affairs and Trade (MOFAT) inking the agreement. As stated, the agreement shall only take into force on the first day of the third month following the month in which the contracting parties receive

The last stop was the beach called ‘Dongmak Haesu Yokjang’ where the students and teachers played volleyball. Their smiles in spite of the feeling of tiredness detached them from the ‘ppalli-ppalli’ culture. FEWA Administrative Adviser Rebenson Recaña said that workers cannot wait for 60 years of age in order to get their money. Moreover, that money is very prone to alleged corruption under the SSS agency. “I am not against to the said bilateral agreement. I am only against to SSS plan of transferring our NPS money to their agency. Honestly, I don’t have trust to SSS officials anymore. That money which is the fruit of the workers’ years of hard labor can become an easy target for some greedy government officials in the Philippines, particularly in the social security agency. When all these happen, the time and effort spent by the workers in working and waiting for their well-deserved benefits may just end up to frustration and grief,” he added.
