TAGAYTAY - A CITY OF CHARACTER ONE OF THE SAFEST CITIES IN THE PHILIPPINES

Perched 2,500 feet above sea level, at the highest point of the province of Cavite, the City of Tagaytay has long attracted visitors for its cool mountain breeze, paradise gardens and the magnificent view to that phenomenon of a “Lake-Volcano-Lake” called Taal. Most recently, however, a new transition can be noticed in the local government and within the community itself, that could probably attract more tourists to this city that’s only next-door to Manila. Used to be, Tagaytay seemed a distant town, but now, 53 kilometers don’t feel so far, with new highways and improved routes, linking the city closer to Manila. Incumbent Mayor Francis N. Tolentino now envisions Tagaytay to become a “City of Character” through “re-indoctrination” of the good old Filipino values that have been forgotten through time. The natural endowments which make this city so popular can only be complemented by a community with “character” – good ones, at that. CHARACTER-REBUILDING PROGRAM The mayor is in his third and last term of office, which started in 1986, when he was officer-incharge for the position at the young age of 26. He was eventually voted as mayor in 1994. Such age would impart the mayor’s idealism and aggressiveness and this was reflected in his choice of programs. The ambitious character-rebuilding project, however, will probably be the one which people would remember him for, provided he succeeds in meeting his goals.

The program sounds too idealistic, too perfect to realize. “To be a true city of character where elective officials, community leaders, and citizens recognize the importance of good character and a community with a strong family, safe homes and streets, effective education, productive business and people who care about one another.” Yet it may also be within reach. Tagaytay occupies a land area of only 6,615 hectares, representing 5.15 percent of Cavite’s total area. Its population, meaning actual residents, number a meager 45,000 with 7,000 households. And the visitors who create all the raucous company during peak seasons balloons up the population to 100,000 every year. So with his incumbencies, Mayor Tolentino may actually have a chance to promote a positive environment which emphasizes “positive character qualities in every sector of the community.” “The program is actually not new. Traditional Filipino values have been inculcated in us by our elders when we were kids. We’ve just forgotten about them, so we believe from a good, sound character, we can function better”, Mayor Tolentino explained. Truthfulness, patience, gratefulness, forgiveness, responsibility, dependability, cleanliness, hard work, discipline, humility, initiative, generosity – these values have been selected to be the “characters of the month” for this year. NATION OF CHARACTER The program, launched in April 2000, has made Tagaytay one of the most peaceful cities in the country. A crime efficiency rating of 93.85 percent as well as recognitions from various institutions for its environment maintenance projects, stamps the city’s claim to being one of the “hottest cities” of the year, as dubbed by the local magazine Graphic. Derivative Citizenship – The unmarried child, whether legitimate, illegitimate or adopted, below eighteen (18) years of age, of those who re-acquire Philippine citizenship upon effectivity of this Act shall be deemed citizens of the Philippines. Section 5. Civil and Political Rights and Liabilities – Those who retain or re-acquire Philippine citizenship under this Act shall enjoy full civil and political rights and be subject to all attendant liabilities under existing laws of the Philippines and the following conditions: (1) Those intending to exercise their right of suffrage must meet the requirements under Section 1, Article V of the Constitution, Republic Act No. 9198, otherwise known as “The Overseas Absentee Voting Act of 2003” and other existing laws; (2) Those seeking elective public office in the Philippines shall meet the qualification for holding such public office as required by the Constitution and existing laws and, at the time of the filing of the certificate of candidacy, make a personal and sworn renunciation of any and all foreign citizenship before any public officer authorized to administer an oath; (3) Those appointed to any public office shall subscribe and swear to an oath of allegiance to the Republic of the Philippines and its duly constituted authorities prior to their assumption of office: Provided, that they renounce their oath of allegiance to the country where they took that oath;

(4) Those intending to practice their profession in the Philippines shall apply with the proper authority for a license or permit to engage in such practice; and (5) That right to vote or be elected or appointed to any public office in the Philippines cannot be exercised by, or extended to, those who: (a) Are candidates for or are occupying any public office in the country of which they are naturalized citizens; and/or (b) Are in active service as commissioned or non-commissioned officers in the armed forces of the country which they are naturalized citizens. Section 6. Separability Clause – If any section or provision of this Act is held unconstitutional or invalid, any other section or provision not affected thereby shall remain valid and effective. Section 7. Repealing Clause – All laws, decrees, orders, rules and regulations inconsistent with the provisions of this Act are hereby repealed or modified accordingly. Section 8. Effectivity Clause – This Act shall take effect after fifteen (15) days following its publication in the Official Gazette or two (2) newspaper of general circulation. PRESIDENTIAL DECREE 185 BALIKBAYAN ACT PURPOSE OF THE LAW To allow a natural born citizen of the Philippines who has lost his Philippine citizenship to be a transferee of private land, for use by him as his residence. Natural born citizen defined: One who is a citizen of the Philippines from birth without having to perform any act to acquire or perfect his citizenship. WHO MAY AVAIL OF THE PRIVILEGE GRANTED BY LAW? 1)

Any natural-born citizen of the Philippines who has lost his Philippine citizenship;

In case of married couples, one of them may avail of the privilege PROVIDED, that if both shall avail of the same, the total area acquired shall not exceed the maximum size fixed. A transferee who already owns an urban or rural land may still acquire or be a transferee of additional rural or urban land for --- RESIDENTIAL PURPOSES provided that his total landholdings shall not exceed the maximum area so fixed. A transferee may only acquire 2 lots which should be situated in different municipalities or cities in the Philippines, PROVIDED that it does not exceed the maximum allowable landholding. A transferee who shall acquire urban land shall be disqualified from acquiring rural land and VICE-VERSA.

REPUBLIC ACT 8179 ACQUISITION OF LAND BY FORMER FILIPINOS FOR PURPOSES OF BUSINESS & COMMERCE (Amending the Foreign Investment Act of 1991)

PURPOSE OF THE LAW To allow a natural born citizen of the Philippines who has lost his Philippine citizenship to be a transferee of private land, for use by him for purposes of investment in business or commerce.

In case of married couples, either of the spouses may avail of this privilege provided the total area acquired should not exceed the maximum area allowed by law. In cases where the spouses already owns urban or rural lands for business purposes, they may acquired additional urban or rural lands which when added to those they presently own shall not exceed the authorized maximum area.

LIMITATIONS TO THE ACQUISITION OF LAND 3. A person may acquire not more than two (2) lots which should be situated in different municipalities or cities anywhere in the Philippines, provided that the total area of those lots do not exceed 5,000 sq.m. for urban land or three (3) hectares for rural land for use in business and commerce. 5. Under Section 4 of Rule XII of the Implementing Rules and Regulations of Republic Act 704 as amended by R.A. 8179, a transferee who has already acquired urban land shall be disqualified from acquiring rural land and vice versa. However, if the transferee has disposed of his rural land, he may still acquire rural land and vice versa, provided that this will be used for business. 7. A transferee of residential land acquired under Batas Pambansa Blg. 185 may still avail of the privilege granted under this law.
