A BILL FOR AN ACT TO AMEND TITLE 4, DIVISION 1, CHAPTER 5, OF THE COMMONWEALTH CODE TO ADD A NEW SECTION 15 10 TO ESTABLISH OPERATING HOURS FOR POKER ESTABLISHMENTS; AND FOR OTHER PURPOSES. BE IT ENACTED BY THE SIXTEENTH NORTHERN MARIANAS COMMONWEALTH LEGISLATURE: Section 1.

Findings and Purpose.

The Legislature finds that poker

establishments in the Commonwealth have become targets for criminals as evidenced by the rash of armed robberies committed in the past years and recently in various villages throughout the Commonwealth. Moreover, armed robberies of poker establishments appear to be more frequent during the early morning hours after most business establishments have closed their doors of operation. The Legislature further finds that armed robberies are a major threat to the health and welfare of the employees and patrons of poker establishments, and short of closing poker establishments, one constructive way to alleviate the vulnerability and potentially harmhl risks to employees and patrons would be to regulate the hours of operation of poker establishments. Accordingly, the purpose of this legislation is to limit the hours of operation of poker establishments from 8:00 a.m. to 2:00 a.m. Section 2. Amendment. Title 4, Division 1, Chapter 5 of the Commonwealth Code is hereby amended by adding a new section 1510 and renumbering the remaining sections accordingly to read as follows: "ยง1510.

The hours of operation of poker

establishments licensed to operate poker machines pursuant to 4 CMC fj 1503 shall be limited to the hours of 8:00 a.m. to 2:00 a.m." Section 3. Severabilitv. If any provision of this Act or the application of any such provision to any person or circumstance should be held invalid by a court of

competent jurisdiction, the remainder of this Act or the application of its provisions to persons or circumstances other than those to which it is held invalid shall not be affected thereby. Section 4. Savings Clause. This Act and any repealer contained herein shall not

be construed as affecting any existing right acquired under contract or acquired under statutes repealed or under any rule, regulation, or order adopted under the statutes. Repealers contained in this Act shall not affect any proceeding instituted under or pursuant to prior law. The enactment of the Act shall not have the effect of terminating, or in any way modifying, any liability, civil or criminal, which shall already be in existence on the date this Act becomes effective. Section 5. Effective Date. This Act shall take effect upon its approval by the
