AAP General News (Australia) 06-15-2006 Vic: Shaken baby syndrome killed baby: coroner finds An inquest has found a 14-month-old infant who died of shaken baby syndrome was killed by his mother's boyfriend. MAXWELL JAMES WEBSTER died in the Royal Children's Hospital on December 20 .. 2004 .. three months after he was admitted with severe brain injuries. Coroner PHILLIP BYRNE has found MAXWELL died of non-accidental trauma inflicted by his mother's boyfriend .. BRENDAN BARNES.
MAXWELL was in the care of his mother .. PAULA DUFFY and Mr BARNES at an address in Skye .. on Melbourne's south-east fringe .. when he was found unconscious on September 26 .. 2004. Mr BARNES said he found MAXWELL unconscious when he checked on him .. with his eyes rolled back in his head. He said he yelled at the baby .. then panicked .. picked him up and shook him. MAXWELL was airlifted to the Royal Children's Hospital where he died three months later.
Four medical experts have concluded that the baby died of nonaccidental trauma. Mr BARNES and Ms DUFFY were interviewed by the Department of Human Services .. but both maintained they did not know how MAXWELL was injured. Ms DUFFY later concluded that Mr BARNES must have inflicted the injuries. Mr BYRNE has found .. while he can't be precise as to the circumstances .. MAXWELL was a victim of shaken baby syndrome .. and he was shaken by Mr BARNES. The coroner didn't make any recommendations for prosecution.
