HELP!HELP! On October 25th, 2009 the Special Judge Danial Pfleging committed Kay Kim to the care and custody of the Indiana Department of mental Health. Kay Kim was without a counsel and she tried to plead with the Judge to continue the hearing until the 7th Circuit court of Appeals can rule on the case. She also told the judge that she is also representing herself in three other federal civil law suits and also at a small claims court. The judge based his ruling on “evidence submitted on the oral testimony and written reports of two competent disinterested psychiatrists.” The psychiatrists were not present because the court feels that their presence will be too expensive but yet the Court is willing to spend a few hundred thousands dollars a year to commit her. The Judge refused to hear her and set a surety bond at $1000 even though she already had a $15,000 surety bond with the court. I placed the new bond on 9/25/2009 but the jail refused to release her. She will be in the jail till I do know when. I believe it is illegal for a person who “cannot understand and represent” to be on trial without a counsel. When in jail she was put on lock down. She is in chronic pain but could not get the ibuprofen she asked for. She cannot walk without a cane and was not allowed to have any walking aids. Kay Kim is a very gentle and loving person. She is 50 years old with a petite size build. The court refused to give her due process and a fair trial instead they committed her so that she will break down although there is nothing wrong with her. She is more intelligent and logical person than many other people. She stood for her rights but was bull dozed by our Federal and State judicial system that allow a psychiatrist to write whatever he likes at the expense of the patient. In this country the mentally ill person does not have a voice that’s why she is fighting so hard for things to change and prevent abuse of mental laws to deprive one’s rights to self representation. While she is in court she is very fluent and familiar with the law. The judges fault her on her style and presentation but not on her substance. As of now she has been moved to the Logonsport State Hospital. She is now at the mercy of the Indiana Department of Mental Health who can commit her indefinitely after the 90 days review. This commitment is very cruel and inhumane because the psychiatrist stated that there is no cure for her and yet gives the court permission to commit her.
