RECOMMENDATION(S):

That Council give first, second and third readings to the Langley Waterworks Regulation Bylaw 1995 No. 3482 Amendment Bylaw 2009 No. 4742; and further That Council give first, second and third readings to the Langley Sewerworks Regulation Bylaw 1998 No. 3701 Amendment Bylaw 2009 No. 4743; and further That Council give first, second and third readings to the Langley Garbage Collection Contract Bylaw 1994 No. 3382 Amendment Bylaw 2009 No. 4744. EXECUTIVE SUMMARY:

The Community Charter provides for Councils to adopt bylaws approving the various fees and charges that can be imposed with respect to services being provided. The 2009 – 2013 Five Year Financial Plan Bylaw No. 4738 includes rate increases for the Water, Sewer and Garbage Collection services under Bylaws 4742, 4743 and 4744. These increases reflect increased costs under agreements with third parties and for capital programs for Water and Sewer systems. The annual impact for a typical household which receives all these services is $57. The rate increases are as follows: • • •

PURPOSE:

The purpose of this report is to bring forward three User Utility Rate Bylaws Nos. 4742, 4743 and 4744 for Water, Sewer and Garbage collection for the first three readings.

DISCUSSION/ANALYSIS:

The Community Charter provides for Councils to adopt various bylaws identifying the various fees and charges that can be imposed with respect to various services being provided. The 2009 – 2013 Five Year Financial Plan Bylaw No. 4738 includes rate increases for the Water, Sewer and Garbage Collection services required under agreements with third parties and for capital programs for Water and Sewer systems. The annual impact for a typical household is as follows: • Water User Rates - 5.00% ($15 per average household) • Sewer User Rates - 5.00% ($15 per average household) • Garbage Collection Contract Fees - 18.50% ($27 per average household)

Langley Waterworks Regulation Bylaw 1995 No. 3482 Amendment Bylaw 2009 No. 4742 (Attachment “A”) Bylaw No. 4742 increases the minimum charge for metered water from $151.08 to $158.63 for each six-month period for the first 110 cubic meters of water consumed. The volume of water consumed after the first 110 cubic meters per six-month period increases from $ 0.436 per cubic meter to $0.458 per cubic meter. The flat user rate for residential customers increases from $302.16 to $317.26 per customer. Langley Sewerworks Regulation Bylaw 1998 No. 3701 Amendment bylaw 2009 No. 4743 (Attachment “B”) Bylaw No. 4743 increases the annual flat rate for a distinct premise from $290.62 to $305.16 for residential sewer use. The rate for non-residential sewer use increases from $0.82 to $0.861 per cubic meter of sewage discharged with a minimum of $152.58 per distinct premise for each six-month period. Langley Garbage Collection Contract Bylaw 1994 No. 3382 Amendment Bylaw 2009 No. 4744 (Attachment “C”) Bylaw No. 4744 increases the Solid Waste Rate from $144.58 to $171.33 for residential users receiving garbage collection service. THE CORPORATION OF THE TOWNSHIP OF LANGLEY LANGLEY WATERWORKS REGULATION BYLAW 1995 NO. 3482 AMENDMENT BYLAW 2009 NO. 4742 EXPLANATORY NOTE Bylaw No. 4742 sets the minimum charge for metered water customers at $158.63 for each six-month period for the first 110 cubic meters of water consumed. WHEREAS Bylaw No. 3482, cited as “Langley Waterworks Regulation Bylaw 1995 No. 3482” provides for the regulation of the water works system, water supply and rates; AND WHEREAS it is deemed desirable and expedient to amend Bylaw 3482; NOW THEREFORE, the Council of the Corporation of the Township of Langley, in Open Meeting Assembled, ENACTS AS FOLLOWS: 1.

This Bylaw may be cited for all purposes as “Langley Waterworks Regulation Bylaw 1995 No. 3482 Amendment Bylaw 2009 No. 4742.”

Bylaw No. 3482 cited as “Langley Waterworks Regulation Bylaw 1995 No. 3482 is amended by deleting Section 1, Section 2, Section 7 and Section 8 of Schedule “A” attached to Bylaw 3482 and substituting the following therefore: 1.

BASIC RATES The annual flat rate for a distinct premise is $317.26. Where there were two or more distinct premises on one property roll number in May 2006, the annual flat rate was multiplied by the number of distinct premises. The 2006 increase due to the conversion of the frontage tax to a user fee is being phased in over 5 years (2006 to 2010) in equal increments. Where there was multiple occupancy of a building on one property roll number in May 2006, the annual flat rate was multiplied by the number of distinct occupancies. The 2006 increase due to the conversion of the frontage tax to a user fee is being phased in over 5 years (2006 to 2010) in equal increments. Subject to the following: the annual flat rate for 2009 shall be multiplied by 365/255 and calculated from April 21, 2009.

RATES FOR METERED SERVICE The two (2) meter billings during the year are based on the consumption for the preceding six (6) month period. The rates for each billing will be: The first 110 cubic meters at a flat rate of $158.63 per distinct premise. The remainder at $0.458 per cubic meter. The minimum charge is $158.63 per distinct premises plus meter rent.” Where there were multiple meters on one utility account number in May 2006. ATTACHMENT B THE CORPORATION OF THE TOWNSHIP OF LANGLEY LANGLEY SEWERWORKS REGULATION BYLAW 1998 NO. 3701 AMENDMENT BYLAW 2009 NO. 4743 EXPLANATORY NOTE Bylaw No. 4743 sets the annual flat rate for a distinct premise at $305.16 for residential sewer use. The current rate is $290.62 per distinct premise. The rate for Non-Residential sewer use is set at $0.861 per cubic meter of sewage discharged with a minimum of $152.58 per distinct premise for each six-month period. The current rates are $0.82 per cubic meter of sewage discharged with a minimum of $145.31 per distinct premise for each six-month period.

WHEREAS Bylaw No. 3701, cited as “Langley Sewerworks Regulation Bylaw 1998 No. 3701” provides for the regulation of the sanitary sewer system, sewage treatment and rates; AND WHEREAS it is deemed desirable and expedient to amend Bylaw No. 3701; NOW THEREFORE, the Council of the Corporation of the Township of Langley, in Open Meeting Assembled, ENACTS AS FOLLOWS: 1.

This Bylaw may be cited for all purposes as “Langley Sewerworks Regulation Bylaw 1998 No. 3701 Amendment Bylaw 2009 No. 4743.”

Bylaw No. 3701 cited as “Langley Sewerworks Regulation Bylaw 1998 No. 3701 is amended by deleting Section 1. A., Section 2. A. and Section 4 of Schedule “B” attached to Bylaw 3701 and substituting the following therefore: 1.

Assessment Authority (c) Is to a property having a water service larger than 19 mm in diameter except for water services to a multi family dwellings

The owner shall be charged semi annually based on the sewage discharged for each preceding six (6) month period. The billings will be calculated by multiplying the cubic meters of sewage discharged by the base rate RB where: RB = $0.861 The minimum charge for each six month period is $152.58 per distinct premises. Where there were multiple meters on one utility account number in May 2006. The 2006 increase due to the conversion of the frontage tax to a user fee is being phased in over 5 years (2006 to 2010) in equal increments. RATES FOR CONTAMINATED GROUNDWATER All users of the sanitary sewer shall be charged a fee for the use of the system based on the approved maximum total discharge volume as indicated on the GVS&DD “Application for a Waste Discharge Permit pursuant to GVS&DD Sewer Use Bylaw No. 164.” All users of the sanitary sewer shall be charged for the contaminated groundwater discharged into the system according to the following formula: R = $0.861 per cubic meter.

The current rate is $144.58 per residence.

WHEREAS Bylaw No. 3382, cited as "Langley Garbage Collection Contract Bylaw 1994 No. 3382" provides for a contract for the removal of garbage, ashes, refuse etc. pursuant to "Township of Langley Garbage Collection Bylaw 1989 No. 2800"; AND WHEREAS it is deemed desirable and expedient to amend Bylaw 3382; NOW THEREFORE the Council of the Corporation of the Township of Langley in open meeting assembled enacts as follows: 1. This Bylaw may be cited as "Langley Garbage Collection Contract Bylaw 1994 No. 3382 Amendment Bylaw 2009 No. 4744." 2. Bylaw No. 3382 cited as "Langley Garbage Collection Contract Bylaw 1994 No. 3382", as amended, is further amended by deleting Section 2 and Subsection 2 (a) and substituting the following therefore:

The charge payable by all residential owners receiving service pursuant to Bylaw No. 2800 shall be $171.33. The rate shall be collected with the annual property tax notice and shall be subject to the same terms, conditions and penalties as are applicable to the collection of the annual property taxes." The rate for 2009 shall be multiplied by 365/255 and calculated from April 21, 2009.
