PNP is administratively and operationally under the NAPOLCOM PNP is under supervision only by local executives.
LOCAL Government Units are as follows:
01. DENR - department of environment and natural resources 02. BFP - bureau of fire protection 03. BJMP - bureau of jail management and penology 04. LCR - local civil registrar 05. LTO - land transportation office 06. RHU - rural health unit 07. DFA - department of foreign affairs 08. COMELEC - commission on election 09. BSP - bangko sentral ng pilipinas 10. BFAD - bureau of food and drugs 11. DPWH - department of public works and highway 12. DECS - department of education culture and sports 13. BFAR - bureau of fisheries and aquatic resources 14. POPCOM - population commission
With the simple illustration above, let me limit my discussion on PNP relationship with other local government unit/s. For the information of everybody “RELATIONSHIP” is the key word of my topic. In general PNP is mainly tasked to “SAFEGUARD LIVES & PROPERTY” “PROTECT THE INNOCENCE AGAINST DECEPTION” etc.
In so doing, PNP therefore generally deals with crimes and criminals. To achieve this sensitive endeavor there is great necessity that PNP should have a mutual and symbiotic RELATIONSHIP to others local government units and this really true as I go on with my lecture, my way of giving examples will surely give you a birds eye view on how RELATIONSHIP is very important to PNP.
Example1 PNP and DENR
PNP have arrested illegal loggers who cut narra trees without permit which was loaded on a truck and was transported from its point of origin without permit transport. PNP has to coordinate with the DENR and discuss all possible things as far as law on forest and others matters known to the DENR personnel in such a way that the filing of an appropriate charge in court will surely attained. For your information in this case DENR is the lead agency of the government. Thereby, a symbiotic relationship of PNP to DENR is sought.
Example2 PNP and BFP PNP have responded into a fire incident wherein they were able to arrest one person who set on fire the house of his neighbor due to an old grudge wherein the house owner provoked the incident. PNP will closely coordinate with the BFP personnel in such a way that they can pin point the cause of fire, and others relevant issues. In case fire is on-going PNP has to secure and cordoned the scene to pre-empt looters, thieves who will take chances of doing their desires of taking ones property.
Example3 PNP and BJMP In cases of JAILBREAK, the PNP has to closely coordinate with the BJMP personnel for the recapture of escapees. PNP will see to it that all escapees will re-arrest in such a way that would be occurrence of crime could be avoided.
Example4 PNP and LCR In cases of any crime committed where police investigators facing blank wall as to the exact place where suspect resides LCR is the answer. Wherein the claimant of death benefit is doubtful whether or not the person insured is alive, the possible government agency where police investigators will go is LCR.
Example5 PNP and LTO • Police investigators were able to recover a car napped and get away vehicle of suspects in a robbery case. LTO is the best answer as said local government unit will provide police investigators the necessary information as to whom the said vehicle was registered and where it was registered. This information from the LTO will surely give vital information for the police. Especially when the vehicle was used in the commission of crime, the suspect will attached different plate number, sticker and others accessories of said vehicle so that they can mislead the investigation.
Example6 PNP and RHU
Police investigators really need the RHU participation in the investigation of crimes against person/s (murder, homicide, physical injures, rape, parricide, infanticide, intentional abortion) RHU personnel will provide them (PNP) of MEDICO-LEGAL CERTIFICATE, AUTOPSY, VAGINAL EXAMS, AND OTHER MEDICAL RECORDS needed like dental record. PNP will use these information, results and findings to support the filing of an appropriate charges in court against any would be suspect. Be informed further that possible result of cases involving person will mainly depend how these results, findings presented by medical personnel in court.
Example7 PNP and DFA
Police are in mission to find out whether or not mastermind of bombing the congress is still in the country, definitely DFA will be contacted. If the suspect still in the country, a HOLD DEPARTURE ORDER will implement by DFA in such a way the suspect could leave the country. If suspect was able to slip outside the country, DFA will coordinate to the destination country and facilitate the return of the suspect to the Philippines and face the charges against him.
Example8 PNP and COMELEC In cases where suspect is no where to be found and that his identity could be ascertain, COMELEC record will be provided to the police as reference such as picture, signature specimen, date and place of birth and other personal information of the suspect.
Example9 PNP and BSP In the case of falsification of the Philippine currency by person/s or syndicate, police investigators could not immediately file the case in court without CERTIFICATION from BSP that said currency is indeed fake or spurious one. On the other hand BSP will provide vital information as to the genuineness of the currency in such a way that PNP who is tasked to implement all laws and rules of the land can do so without unnecessary delay and would perpetrator/s
Example10 PNP and BFAD
Police investigators investigated as case of ADULTERATED PRODUCT where suspect using the brand name of a certain product. Police authorities have to closely coordinate with BFAD personnel in obtaining information so that their campaign against intellectual property rights (IPR) in relation to Consumer’s Act could be attained and implemented against the perpetrator/s. In this way, there is a so called equal protection between consumers and manufacturer.
Example11 PNP and DPWH Police authorities who are in-charge in the maintenance of peace and order, protecting and safeguarding lives and properties sought the assistance of DPWH authorities in the installation of street lighting and road sign along a narrow street in Brgy. Sepsepnget, Laoag City. After the installation of lightings and road signs of the same street by the DPWH personnel, upon the initiative of the PNP, constituents thereat congrats the police authorities for doing so.
Example12 PNP and DECS/SCHOOL Police authorities are currently investigating a ranking communist terrorist within their area. According to a reliable source of information, said CT is had finished his baccalaureate degree and a post graduate one. However, all other information cannot be ascertained. Example13 PNP and BFAR Police probers investigating a case of Violation of RA8550 (illegal fishing). Suspects were arrested along the shore in possession of dynamited fishes and a very fine mess but they do not know what specific laws of RA8550 was violated thereby BFAR personnel could guide them on what to do and how to do as far as the filing of an appropriate case in court is concerned.
With all the above cited explanations where PNP closely coordinated to every local government unit, a symbiotic relationship was proven effective and inevitable. RELATIONSHIP OF PNP therefore to any of the above-named government local unit is a MUST. But sometimes this will automatically collapsed once a traditional politician intervened and interfere.
To give you a birds eye view, take this example as your guide in dealing with PNP personnel in such a way that BLAME, ACCUSATION AND CRITISISM will not be thrown to them at times they failed to suppress the existence of any criminal act to our respective locality.
Because of constitutional mandate that CIVILIAN AUTHORITY IS SUPREME OVER THE MILITARY/POLICE, some politician abuse it and resulted to the so called police brutality.
Example: Mr. “A” was arrested by the police for illegal possession of firearm. He will be charge for such act, but Mr. “A” was a diehard supporter of the Honorable Mayor. Mayor called the chief of police and said DO NOT FILE THE CASE ANYMORE, HE IS MY SUPPORTER.
=The chief of police who was selected by the Mayor for such position he cannot say no but YES Mayor. =The worse is that Mr. “A” underestimated now the police and even commit any wrong doing/act any way Mayor is there to ALBOR HIM.
=If the Chief of police do not conform to the Mayor’s proposal, the Mayor says, Hepe better look for another Police Station where you can be more effective.
=Another reason why police hampered of implementation of a real justice is that if not the mayor himself will say so, surely one among his ranchmen who is close to the mayor will brainwash him to go against the police.
TO ATTEND THE REAL JUSTICE, THERE MUST BE A COMPLETE SEPARATION OF AUTHORITY FOR THE LOCAL EXECUTIVES AND THE POLICE AUTHORITIES
Police are sometimes in effective because of the intervention of some politicians in their locality where often times policemen can not do otherwise.
