8. Variation of these Terms & Conditions

You must read these Terms & Conditions carefully before signing the Premier Card or using your Premier Card number. These Terms & Conditions contain some exclusions and limitations of liability. View these Terms & Conditions online at ba.com/premierterms

British Airways may amend these Terms and Conditions at any time subject to giving Premier Cardholders written notice.

1. Premier Card Agreement

9.1 These Terms & Conditions are governed by English Law. British Airways and the Premier Cardholder submit to the non-exclusive jurisdiction of the English courts to resolve any disputes that may arise out of them.

These Terms & Conditions set out the contractual relationship between you, the Premier Cardholder, and British Airways Plc for the use of the Premier Card.

9. Governing Law

2. Definitions “BA Miles Rules” means all of the Terms & Conditions, rules and information relating to BA Miles and the mileage programme on the British Airways Executive Club pages, as amended from time to time, available on the British Airways website at internet address www.ba.com;

Upgrade for Two – Conditions of Use View these Conditions of Use online at ba.com/premierterms 1.

The Upgrade for Two is a single cabin class upgrade available on a single or return booking of up to 2 people. For example: Euro Traveller to Club Europe, World Traveller to World Traveller Plus (where fitted on the aircraft), World Traveller to Club World (where World Traveller Plus is not fitted on the aircraft), World Traveller Plus to Club World, Club World to First.

“Premier Card” means the British Airways Premier Card;

The Upgrade for Two must be booked within 12 months from the date of issue.

“Premier Cardholder” means the person whose name appears on the Premier Card;

The Upgrade for Two can be used in conjunction with published fares sold directly by British Airways, including BA Miles redemption bookings. However, it excludes group bookings and those sold as part of a packaged holiday. The Upgrade for Two can only be applied to bookings that are made in the member’s Executive Club membership country. The Upgrade for Two cannot be used in conjunction with any industry or agency discounted fares.

The Upgrade for Two cannot be used in conjunction with any bookings that have already been subject to an upgrade (Miles for Upgrade or Upgrade for Two) or any other promotions/offers.

3.4 The Premier Cardholder is the only person who may use the Premier Card for any purpose whatsoever. Premier Cards are not transferable.

Rules of the ticket are governed by the original fare paid. In the case of redemption tickets, standard redemption rules apply.

3.5 The Premier Card is only valid for use until the end of the month indicated on it in the year indicated on it.

The Upgrade for Two is available for British Airways and franchise operated flights only. Partner and codeshare flights excluded.

3.6 The Premier Card remains at all times the property of British Airways and must be returned to British Airways whenever the Premier Cardholder is requested to do so.

7.

The Upgrade for Two cannot be applied to a booking containing any other carriers than British Airways.

3.7 Signing the Premier Card or using the Premier Card number confirms participation as a Premier Cardholder subject to these Terms and Conditions.

To upgrade a new BA Miles booking please go to ba.com or contact your Service Centre, or to upgrade an existing BA Miles booking please contact your Service Centre. To upgrade a new paid booking please go to ba.com, or, in UK and North America contact your Service Centre. If outside UK and North America please contact your Sales Office. To upgrade an existing paid booking, please contact your Service Centre. You must advise at time of booking that you wish to use your Upgrade for Two. The Upgrade for Two cannot be redeemed at the airport.

When a Member books an Upgrade for Two direct with British Airways the Member must pay for the ticket, but is permitted to give the ticket and upgrade to someone else.

“BA Miles” means the BA Miles awarded under the BA Miles Rules; “British Airways” means British Airways Plc; “Loss” means losses, costs, damages, injuries, accidents or claims (whether direct or indirect) suffered by Premier Cardholders in connection with the provision of Services or BA Miles;

“Services” means benefits, services and facilities available for the use of Premier Cardholders.

3. Cards and Cardholders 3.1 The Premier Card is issued to the Premier Cardholder at the discretion of British Airways. 3.2 Retention of the Premier Card by the Premier Cardholder is at the discretion of British Airways. 3.3 In the event of British Airways in its discretion revoking a Premier Card the Premier Cardholder shall return the Premier Card to British Airways without delay.

3.8 These Terms & Conditions do not constitute or create a members’ or proprietary club. 3.9 Where a Premier Card is issued as the result of an agreement between British Airways and a third party, such as the employer of the Premier Cardholder, British Airways may disclose to and receive from the third party personal data relating to the Premier Cardholder for the purpose of reviewing the issue or renewal of the Premier Card.

4. BA Miles 4.1 The rules governing the accrual, ownership, holding and redemption of the BA Miles are contained in the BA Miles Rules and are applicable to the Premier Cardholder.

10. The Member and/or those travelling using the Upgrade for Two will be personally responsible for any tax payable by them as a result of this offer.

4.2 British Airways may from time to time amend or terminate the mileage programme available to Premier Cardholders. Any such changes shall be notified to Premier Cardholders in advance and in the event of termination British Airways will use its reasonable endeavours to give at least 6 months notice.

11. The Upgrade for Two is not an entitlement to travel and is subject to capacity restrictions.

5. Premier Cardholder’s Tax Liability 5.1 British Airways makes no representations as to any personal or other tax liability of Premier Cardholders as a result of their Premier Card or their participation in the mileage programme. Such a tax liability may arise, for example, if a Premier Cardholder obtains BA Miles as a result of business expenditure. 5.2 The Premier Cardholder is solely responsible for any tax liability incurred as a result of their holding a Premier Card or participation in the mileage programme.

6. Exclusion of Liability 6.1 British Airways will not be liable for any Loss resulting from amendment to or termination of any of the Services except for Loss caused by its own negligence. 6.2 British Airways will not be liable for any Loss if by reason of local legal or regulatory restrictions the whole or any part of the Services cannot be made available in certain countries or to certain individuals.

7. Termination of the Scheme

7.1 British Airways may terminate the Premier Card scheme at any time but will use its reasonable endeavours to give at least six months’ notice to Premier Cardholders. At the end of the period of notice Premier Cardholders’ rights to use the Services (including the accrual and redemption of BA Miles) shall cease.

12. Cancellations: If you cancel your upgraded booking the rules of the original ticket apply. If a cancellation is made more than 24 hours before departure your Upgrade for Two will be reinstated, provided the Upgrade for Two is within its 12 month validity period. If a cancellation occurs within 24 hours of departure, the Upgrade for Two will be invalid for further use. 13. If using your Upgrade for Two on an existing booking and your ticket has already been issued, you will need to send in your tickets 21 days in advance of travel, for your tickets to be re-issued. If you hold an e-ticket this will take 72 hours. 14. Infants: If an upgraded booking contains an infant travelling on an infant fare, the infant will be automatically upgraded with the adults. Child fares will be subject to the same rules as adults. 15. Household Accounts: Any Household Account Member who earns the Upgrade for Two must redeem it personally. The Upgrade for Two is not part of the Household Account pool and cannot be redeemed by another Member of the Household Account. Household Account Members who earn the Upgrade for Two are subject to applicable Household Account redemption rules, whereby the Upgrade for Two can only be used for Members within the Household Account. These upgrades cannot be allocated to Executive Club members under age 18. An upgrade earned by a member under 18 is allocated to the Head of that member’s Household Account. 16. Standard booking lead times apply for your area, Members are responsible for paying additional taxes, fees, charges and surcharges.
