MEMORANDUM OF ORAL DECISION DELIVERED BY S. J. SUTHERLAND ON MAY 11, 2009 AND ORDER OF THE BOARD This hearing was held to provide the Board with an update on settlement discussions on an application by GCD Trustee Limited (Applicant/Appellant) for a Zoning By-law amendment and site plan approval related to a property north west of Gerrard Street East at Clonmore Drive in the City of Toronto (Subject Property). Counsel for the Applicant/Appellant informed the Board that discussions between his client and the City of Toronto (City) have been ongoing since November, 2008 and, while some progress has been made, a settlement has not yet been reached. He said he could not say with certainty that one would be reached. He asked for a five-day hearing on the applications to be scheduled “as early as possible”. Counsel for the City

told the Board that Council did not meet during July and August, but expressed no objections to proceeding before the fall. Consequently, a five-day hearing commencing Monday, July 20, 2009 at 10 a.m. will be held at the Ontario Municipal Board, 655 Bay Street, 16th Floor, Toronto, Ontario. Although no further notice is required, Counsel for the Applicant/Appellant told the Board it is his intention to send out notice, according to the Board’s rules, to those who have been involved in past hearings on this application. This Member is not seized. This is an Order of the Board.
