The OCO is an independent state agency with authority to investigate cases handled by the Department of Human Services (DHS) and private child-placing agencies. Our investigations consist of reviewing case files to monitor agency compliance with laws, rules, and policies that govern the handling of children’s protective services, foster care, adoption services and juvenile justice cases. The OCO does not have the authority to investigate situations involving custody, parenting time, child support, guardianships, school problems, decisions by courts, adoption consent decisions, and actions by attorneys and law enforcement. In Michigan, the MCI Superintendent has the sole legal authority to grant and deny consent to families wishing to adopt a child through our abuse/neglect system. Our office does not have the legal authority to investigate or otherwise become involved in adoption consent decisions. Your only recourse is a legal one in that if you want to appeal Mr. Johnson's decision, you must hire an attorney and file a motion with the judge who terminated the biological parents' parental rights.
