NOTICE OF EX PARTE COMMUNICATION BY THE INDEPENDENT ENERGY PRODUCERS ASSOCIATION
Pursuant to Article 8 of the Commission’s Rules of Practice and Procedure, the Independent Energy Producers Association (“IEP”) provides the following notice of ex parte communication. On November 13, 2008, beginning at 2:30 p.m., Steven Kelly, Policy Director, met with Commissioner Dian Grueneich and Traci Bone and Theresa Cho, advisors to Commissioner Grueneich, at the Commission’s offices in San Francisco. The communication was initiated by a notice from the Commission of an all-party meeting with Commissioner Grueneich to present their views regarding conditions proposed in the Alternate Proposed Decision in this proceeding. The meeting was also attended by Administrative Law Judge Jean Vieth; Nancy Ryan and Matthew Deal, advisors to President Peevey; Jane Whang and Joseph Como, advisors to Commissioner Chong; and Lindsay Brown, advisor to Commissioner Bohn.

In this meeting, Mr. Kelly stated that (a) IEP was interested in moving forward with transmission to interconnect renewable resource zones as quickly as possible, (b) if the Commission determined that the Sunrise Transmission Project should be approved, then IEP was concerned that the Proposed Decision (PD) suggesting the need for an additional Application to be served by San Diego Gas and Electric Company (SDG&E) in 2009 to review SDG&E’s Compliance Plan may result in unnecessary delay, and (c) as an alternative, IEP recommended considering, as a condition of approving the Sunrise Transmission Project, additional language in the Final Decision committing the utility to an open, transparent, competitive Renewable Request for Offer (Renewable RFO), to be fully completed by December 31, 2009, resulting in firm commitments for renewable resources that can become operational and interconnected coincident with the energization of the Sunrise Transmission Line (or soon thereafter) to help meet SDG&E’s RPS obligations/commitment to achieve 33% of retail sales from renewable power by 2020. There were no written, audiovisual, or other materials used during the communication.
