AFFIDAVIT OF JASON MARTINEZ Personally appeared Jason Martinez, of Vernon, Connecticut, who, being duly sworn, testified as follows: 1.

I am over twenty-one (21) years old and I understand and appreciate the obligations of an oath. I am employed with the Hartford Fire Department. I attended the Hartford Fire Academy from October 22, 2007 to January 25, 2008. During my stay at the Academy, Deputy Fire Chief Daniel Nolan was the head of the Training Division. At the Academy, Deputy Chief Nolan would usually address the recruit class in the morning, during formation, or at the end of the day. During the month of October, Deputy Chief Nolan asked if members of the recruit class were interested in participating in a charity event known as the "Big Climb", organized by the Lea Foundation. I also became aware that Squad Leaders, were asked by Deputy Chief Nolan to sell tickets for an event to benefit of the St. Patrick's Day Parade.

During the training, the class of recruits would receive punishments in the form of "tower exercises". These tower exercises consisted in having to run up and down a tower which is six stories high. When recruits did not run the daily run fast enough, Deputy Chief Nolan would punish the whole class with tower exercises. Usually, he would add towers depending on the number of recruits who finished the run behind him.

The vast majority of the tower punishments issued at the training academy during my stay, were issued for failing to run up to the standards set by Deputy Chief Nolan. By the end of December of 2007, the recruit class had accumulated a very large number of towers that we had to run.

On or around January 2008, Deputy Chief Nolan asked the recruits to donate or obtain donations for a charity raffle. He stated that if we obtained donations, he would reduce the number of towers that we had to do. He said that the more donations we brought in, the more towers he would reduce.

Several recruits brought gifts or donations to try to reduce the towers that we had to run. I brought in "Timberland" t-shirt valued at $25.00.

12.

I remember that gifts such as video game consoles and free salsa lessons were donated by the recruits.
