ABOUT MRTP ACT  The MRTP ACT 1969, came into

existence on 1st June 1970.  It is applicable to all over India except Jammu and Kashmir due to article 356.

OBJECTIVES  To restrict the monopolies trade

activities and prevent of concentration of economic power in few hands.  Control of monopolies, restrictive and unfair trade practices which are against the public interest.

SCOPE AND APPLICATION  Applies to all companies which are

registered and operate in India under the company act 1956.  Preventing unreasonable competition in the production of goods ,distribution and supply of goods.  Prohibit unfair trade practises.

MRTP COMMISSION

PENALTIES  A fine up to Rs 5000 and

imprisonment up to 6 months to 2 year on first instance.  A fine up to Rs. 5000 and imprisonment up to 2 to 3 years on second instance.
