APOLLON GADINGAN y GALANGCO(at large), Accused. x---------------------------------------x MOTION TO CONSOLIDATE The Prosecution, through the undersigned public prosecutor most respectfully states: That two (2) criminal cases for violation of sections 11 and 12 of R.A 9165 have been filed against the accused; That the said two (2) cases arose from a single incident that took place on March 12, 2017 in Brgy. Sacaang, Galimuyod, Ilocos Sur; That said two (2) cases involve the same parties and set of facts and the prosecution will be utilising the same set of evidence for those two (2) cases; WHEREFORE, in the interest of justice, it is most respectfully prayed of this Honorable Office to order the consolidation of the two (2) criminal cases filed against APOLLON GADINGAN y GALANGCO Other relief, just and equitable, is likewise prayed for. That the information in the above-entitled case was filed on 7 March 2016, and that the accused have not yet been arraigned; That the private complainant executed an Affidavit of Desistance alleging among others that incident subject matter of the case stemmed from a simple misunderstanding and that he had already forgiven the afore-named accused and that he would no longer testify against said accused and he would not object if the case would be dismissed or withdrawn and that all his witnesses have already turned hostile to his cause. A copy of the said Affidavit of Desistance is hereto attached as Annex “A”. WHEREFORE, in the interest of justice, it is most respectfully prayed of this Honorable Court to grant the motion for the withdrawal of the Information filed against the above-named accused, there being no more witness to prove his criminal liability.
