APPLICATION U/S-426 (1) & (1) (c) Cr.P.C. for Dilawar Khan S/o Ikhtiar Khan, caste Pathan, R/o Street No. 3, Mehboob Colony, Mian Channu city (Khanewal). Respectfully Sheweth;1.

That the contents of main appeal may be considered as part & parcel of this application.

That the evidence available on the record did not connect the applicant with the offence alleged in the F.I.R.

3.

That there was no recovery from the person of applicant.

4.

That all the witnesses are police officials. The complainant is also Investigation Officer. Under any and all the obligations, they have to support their version by this reason falling within the preview of interested witnesses.

5.

That the petitioner is behind the bars from the date of arrest i.e. 15.5.1997, while convicted vide judgment dated 23.12.99 and has earned a right for suspension of sentence.

6.

That the defence evidence produced by the applicant was not properly considered by the learned trial court.

7.

That the applicant is innocent and falsely implicated in this case, due to ulterior motive and malafide intention. It is therefore, respectfully prayed that the sentence of applicant may please be suspended in the interest of justice, till the final disposal of main appeal. Any other relief, which this Hon’ble Court deems fit, may also be awarded to the applicant in the interest of justice. Humble Applicant,
