What is the issue in this case? Kayleff Yak is a bovine which transfers habitat regularly depending on the season. Applicant and respondent are two contiguous state populated by this animal. Applicant is seeking compensation because of the decrease of the Yak population which is an important part of their culture and is traditionally hunted as right of passage to adulthood. Respondent is hunting the same for a lucrative medical and scientific research purposes.

What were the arguments of the applicant? Applicant would like to stop the hunting and be compensated for what it accuse respondent of state sponsored hunting.

What were the arguments of the respondent? Respondent argues that the hunting is for research purposes in order to develop a synthetic drug currently harvested from the animal and that they have imposed quota to lessen its impact to the population.

Who do you think won has argued better? State your conclusion. Respondent has argued better. Hunting for medical and scientific research is a valid purpose. They have put in place controls such as issuing licenses and that the hunting will stop in 3 years. Applicant’s argument to conserve the Yak resource is laudable but has failed to prove the respondent’s incapability to control the hunting of the animal. The imputation of applicant that respondent is using the research as a shield to enrich itself was not backed up by irrefutable testimony and evidence.

State your learning experience. I was inspired by the participants clear pronunciations, respectful tones and composure even if the judges were proving and interrupting. I had the impression that the participants were well prepared.
