INCIDENT DETAILS.
On 03/28/09 at approximately 2015 hours while in Marked Patrol Unit #211 responded to the intersection of Main Street and Westland Street for a,rebprt of a ^|destrian being struck by a Motor Vehicle. Upon arrival I spoke with the Three above listed witnessesrHollrSeral Jf>.O.B 10/11/59, Hemanez, Enrique D.O.B 05/30/56, and Myers, Harold Jr. D.O.B 05/18/55. Holt state| thathji wa|J|his vehicle behind the above listed suspects vehicle and witnessed the accident. Holt statedahi^^o#e-iistid victim Castillo, Noemi D.O.B 09/23/50 was crossing Main Street and that she was halfway through the crosswalk when the above listed vehicle traveled threw the Red Traffic Signal and struck Castillo. Holt statf^ttet: Castillo/pSgtit Square in the center of the vehicle.and rolled over the hood falling off of the hood on the passenge^stde ontoflfte road. Holt described the suspects vehicle as a Blue or Green Older Model BMW bearing the CT. Registration Plate of 416XKE, and that it was last seen traveling North on Main '. I then spoke to the above listed witness Hernanez, Enrique D.O.B 05/30/56. Hernanez stated that he was sitting in the passenger seat of witness . Holts vehicle behind, the above listed suspects vehicle at the red traffic signal. Hernanez stated that the operator of the suspected vehicle was talking on the cell phone at the light. Hernanez stated that Castillo was half way across Main Street in a Crosswalk when the above listed suspects vehicle ran . through the Red Traffic Signal turning left striking Castillo with the center of the vehicle. Hernanez stated that Castillo flew onto the hood of the vehicle and rolled off on the passenger side. Hernanez stated that he would be able to I.D. a suspect in a Photo array . I then spoke to the third witness Myers, Harold D.O.B 05/18/55. Myers stated that he was standing along side Main Street talking to the victim (Castillo). Myers stated that after there conversation Castillo was crossing Maia:S®eet in the Crosswalk and was about halfway through the Crosswalk when a vehicle struck her. Myers stated that the vehicle was an Older Model BMW Blue in Color bearing the CT. registration Plate 416-XKE, Myers. stated that he last saw the vehicle traveling North on Main Street. Myers stated that.hj: wjmld be able to I.D. a suspect in a Photo array. A description of the fleeing vehicle and last direction of travel was broadcasteji .on Hartford Police Patrol Channel 1. The CT. Registration Plate 416-XKE was ran through DMV files and came back registered td%e" al3dve;a1re^^fe|nas5 John, J D.O.B 01/10/66 at 16 Melrose Street Hartford CT. Assisting Units drove by 16 Melrose Street in attempt, to locafe||e^p^V^|Bipproximately 2023 hours. The vehicle was located in the drive way with a operator in the drivers seat and the car running. Officers approach|lme vehicle and asked .the operator later identified as the'arrested Thomas, John, J . Unit #78 placed Thomas, John, J under arrest for Dnvlto|--Wh%*intoxicated refer to Hartford Case #09-12024, and transported him to booking. I was notified that they had found the evading car and its operator. I proceeded to 16 Melrose Street to observe damage to the vehicle . Upon arriving at 16 Melrose Street I spoke with the above listed Johnson Cathy D.O.B 08/14/74 she stated that Thomas was her husband and that he has been driving the the above listed BMW all night long. Johnson stated that Thomas did not tell her that he had hit anybody or anything tonight. I then observed the vehicle in the driveway. I observed fresh scratch marks in the center of the hood and fresh scratch swirl marks on the top right side of the hood. The marks line up were the witnesses stated that Castillo was struck and the area of the vehicle she rolled off of. There was also fresh dent and scratches SUPPLEMENT DISTRIBUTION:

I observed a opened Twelve Pack of Heniken Beer in the passenger front seat, a cooler on the front passenger floor with Five Heniken Beer within arms reach of the Operator seat, and a open Heniken Beer in a Brown Paper Bag on the Center Console. The victim (Castillo) was transported to Hartford Hospital by AMR Unit#23. I then followed up with the victim at Hartford Hospital the Doctor told me that Castillo was stable and that she was complaining of pain in her lower extremities and that they were waiting for X-Rays to be done.

I ASKED TO HAVE THOMAS REMOVED FROM THE CRUISER AND THE HANDCUFFS TAKEN OFF. I THEN HAD HIM STEP TO THE FRONT OF THE CRUISER. AS HE DID SO I NOTED THAT HE WAS VERY UNSTEADY ON HIS FEET, WALKING WITH A WIDE STANCE AND USING HIS ARMS TO ASSIST WITH BALANCE. I ASKED HIM TO ASSUME A FEET-TOGETHER-HANDS-AT -HIS-SIDE STANCE, THEN ASKED WHERE HE WAS GOING, WHERE HE WAS COMING FROM AND IF HE HAD CONSUMED ANY ALCOHOL THIS EVENING. HE STATED THAT HE WAS COMING HOME FROM HIS SISTER'S HOUSE AND THAT HE HADN'T HAD "ANYTHING TO DRINK REALLY". AFTER REPEATING THE ALCOHOL CONSUMPTION QUESTION HE STATED "A FEW BEERS". I ASKED IF HE RECALLED BEING INVOLVED IN A MOTOR VEHICLE CRAS: ". HE SWAYED WHILE TRYING TO MAINTAIN THE STANCE. I ALSO NOTED THE ODOR OF ALCOHOLIC BEV TH, SLURRED SPEECH AND GLASSY BLOOD-SHOT EYES. BASED UPON THESE OBSERVATIONS I DECIDED T STANDARDIZED FIELD SOBRIETY TESTS. THOMAS DENIED ANY VISUAL OR PHYSICAL IMPAIRMENTS WH1 HIM FROM PARTICIPATING. HGN: EXPLAINED. HE ACKNOWLEDGED UNDERST. DED IN RESPONSE TO THE STIMULUS DEMONSTRATING A DEFINITE LACK OF SMOOTH PIT. .GMUS AT MAXIMUM DEVIATION, AND ONSET OF NYSTAGMUS PRIOR TO 45 DEGREES, BILATERALLY. HE* ED TWICE TO KEEP HIS HEAD STILL. WALK AND TURN: HE WAS UNABLE TO CORRECTLY AS ART POSITION, FEET OFFSET AND ARMS RAISED. HE TWICE HAD TO QUICKLY ADJUST FEET/RAISE ARMS TO PREVENT FALLING. I EXPLAINED/DEMONSTRATED THE TEST. HE ACKNOWLEDGED UNDERSTANDING. HE IMMEDIATELY RAISED HIS ARMS AS HE STARTED TAKING STEPS. ON THE FIFTH STEP HE HAD TO QUICKLY ADJUST FEET, DANCING AROUND TO MAINTAIN BALANCE, THEN RESUMED TAKING STEPS. ON THE NINTH STEP HE STOPPED AND JUST LOOKED AT ME. HE THEN ASKED WHAT HE SHOULD DO? I REMINDED HIM THAT HE SAID HE UNDERSTOOD THE DIRECTIONS. HE TURNED, TO THE RIGHT INSTEAD OF THE LEFT AS DIRECTED, AND TOOK NINE UNSTEADY, ARMS RAISED STEPS BACK. ATE OF UPPLEMENT

ONE LEG STAND: EXPLAINED/DEMONSTRATED. HE ASKED IF THIS WAS SOMETHING SPECIAL FOR BLACK PEOPLE, THEN ACKNOWLEDGED UNDERSTANDING. AS SOON AS I DIRECTED HIM TO START HE RAISED HIS LEFT LEG, BENT AT THE KNEE, AND HIS ARMS ABOVE HIS SHOULDERS. HE DROPPED AND RAISED HIS LEG TWO MORE TIMES. AROUND THE ONE-THOUSAND-NINE COUNT HE BEGAN HOPPING ON HIS RIGHT LEG THEN DROPPED HIS LEFT, DANCING AROUND TO PREVENT FALLING THEN JUST STOOD THERE. BASED UPON MY OBSERVATIONS TO THIS POINT I BELIEVED THAT ACCUSED THOMAS WAS INDEED OPERATING UNDER THE INFLUENCE OF ALCOHOL AND/OR DRUGS. WHEN I STARTED TO ADVISE HIM THAT HE WAS UNDER ARREST AND APPLY HANDCUFFS HE TENSED YELLING "I DON'T HAVE ANY WARRANTS!" AFTER BEING P,LACED IN THE REAR OF UNIT 15 HE BEGAN RANTING ABOUT HOW I "FUCKED" HIM WAS TAKING HIM "OFF THE LINE" AND THAT HJ^6tto!W$^TO "KILL" ME. WHEN I BEGAN READING HIM HIS MIRANDA WARNING HE YELLED "I KNOW MY RIGHTS!", AS I CONTINUE]^B»IR^^AWAV FROM ME AND BEGAN REPEATING "LA,LA,LA,LA,..." UNTIL I STOPPED. A SEARCH OF HIS VEHICLE YIELDED NUME^RQIJS BOTTLESjfoHEINEKEN" BEER, AND ONE OPEN ONE IN A PAPER BAG IN THE CONSOLE. SHORTLY THEREAFTER HE WAS TRANSFERRED;!^^ r"^|E»ANSPORT TO BOOKING BY OFC. DIANA. HE CONTINUED HIS RANT ABOUT HOW WE WOULD HAVE TO WATCH OUT INSIDE BOOKING HE STATED, "FUCK YOU TO" THEN GE WHEN BOOKING OFFICER K. LEE, DECLINED TO TAKE HIS SIDE. AS I TRIED TO ESCORT HIM TO THE INTOXY REFERRING TO US AS "PIECES OF SHIT" AND MAKING PHYSICAL CHALLENGES. I DIRECTED HIM TO SIT ON THE DEROGATORY. HE INITIALLY SAID HE WOULD TAKE THE BREATH TEST, THEN GRABBED THE TUBE. I READ THE IMPL AND OFFERED THE OPPORTUNITY TO CONTACT AN ATTORNEY, DECLINED WITH PROFANITY. WHEN IT WAS TIME TO BLOW HE INDICATED HE WASN'T READY, BUT WOULD DO SO WHEN HE WAS, THEN GRABBED THE TUBE AGAIN AND WOULD NOT LET GO. HE FAILED REPEATEDLY TO COMPLY WITH DIRECTIONS REGARDING THE TEST. BASED ON THIS BEHAVIOR I ENTERED REFUSAL. HE CONTINUED WITH HIS RANT. HE WAS LEFT IN THE CARE OF THE BOOKING STAFF. HIS OPERATOR'S LICENSE WILL BE MAILED ALONG WITH A COPY OF THE REFUSAL. HIS VEHICLE WAS TOWED BY CENTRAL AUTO BODY, #215943. SI VTEOF JPPLEMENT
