COURT OF APPEALS: THE MURDER OF KAYMAZ İS SELF-DEFENCE 18 June 2009 Court of Appeals has adjudged that the police officers behaved within limits of selfdefence, in trial concerned with killed Uğur Kaymaz in Kızıltepe.
SOL (NEWS DESK) Court of Appeals, First Criminal Office affirm the verdict of acquittal which was brought in Eskişehir Assize Court, about police officers killed 12 yers old Uğur Kaymaz and his father.Court of Appeals has adjudged that the police officers behaved within limits of self-defenced. The trial of 4 police officers had sent to Eskişehir by reason of safety, to be judged of “committing homicide on a not to appear of its perpetrator basis, going beyond the limits of self-defense” and to be demanded 12 years imprisonmets.“
İn the report of Forensic Medicine that presented to trial which was handled ın here, for Uğur Kaymaz who has depicted as 12 years old, 1.60 lenght, a midline boy, it is not possible to start firing that this aged boy who have 9 bullet wound in back, had said. But the court had decided the verdict of acquittal about police officers in contravention of the report.
Court of Appeals affirm this verdict of acquittal. That the accused police officers’ action is within limits of selfdefence, there is no ineffectiveness in appreciationing of the evidences and just because of this reason, verdict of acquittal which was given by local court is licit, was defended. Kaymaz family has have right of “formal request for correcting judgement” in this stage. But this “formal request” will be also handled in Court of Appeals, First Criminal Office which affirm the verdict of acquittal. Kaymaz family will carry this case to European Court of Human Rights (ECHR) when domestic laws have exhausted.
