DISTRAINT ON PERSONAL PROPERTY

A) If the amount is in excess of P1,000,000 – Commissioner or his duly authorized rep B) If the amount is 1,000,000 OR LESS -RDO Shall seize and distraint

SEIZURE OF GOODS

Service of Distraint Warrant to the owner of Goods, Chattels, Effects and Personal Property

For Debts and Credits, service to the person owing or in possession of such credits or his agents

For Stocks, Service to the President, Manager, Treasure or other Responsible officer of the Corporation, Company or Association

For Bank Accounts, service of warrant upon the taxpayer and any responsible officer of the bank.

NOTIFICATION To be exhibited in not less than 2 public places in the municipality of city where the distraint is made( one of which is at the office of the Mayor). Time, place of sale and the articles distrained should be specified.

SALE (should not be less than 20days after notice to the owner of possessor of the property

For Sale of Stocks, Officer making the sale shall execute a Bill of sale which shall be delivered to the buyer.

If there is any residue, it shall be returned to the Owner.

If proceeds are insufficient, proceed to Levy of Real Property.
