GOVERNMENT’S RESPONSE Re: CONSOLIDATION Four related cases were charged in separate Indictments captioned as follows: U.S. v. Daniel Riley, 07-189, U.S. v. Jason Gerhard, 07-168, U.S. v. Cirino Gonzalez, 07-191, and U.S. v. Robert Wolffe, 07-190. On October 31, 2007, a Grand Jury sitting in the District of New Hampshire returned a Superseding Indictment consolidating all four of those cases in the case now captioned United States v. Daniel Riley, Jason Gerhard, Cirino Gonzalez and Robert Wolffe, Cr. No. 07-189-01/02/03 & 04-GZS, thereby making consolidation pursuant to Federal Rule of Criminal Procedure 13 moot.
