from 667 Main Street {My Country Store}, East Haven. {See Ofc. Spaulding's report 09-2650}. While inside the store, this officer was watching store owner, Wilfrido Matute {D.O.B. 6/26/67} take down numerous registration plates with a drill gun from a wall inside the store. A short time later, this officer saw a white male subjecUater identified as James Manship (D.O.B. 12/18/63) enter the store. This officer saw Manship approach a hispanic male employee inside the store and noticed that Manship was having a conversation with the male subject and that the male subject was pointing his finger at police while speaking with Manship. At this time Ofc. Spaulding had exited the store with a stack of license plates that were seized from the store and had secured the plates inside his police cruiser, which was parked in the front parking lot of this store. Ofc. Spaulding reentered the store and had approached Manship, who had been standing by the store's register area. This officer could not hear the conversation that Ofc. Spaulding was having with Manship but was later advised after this incident by Ofc. Spaulding that he had verbally advised Manship to stay his distance from police while police were investigated this incident inside the store and that Manship had been advised by Ofc. Spaulding in the past week to stay a safe distance from police while police conducted motor vehicle stops. While this officer was bending down to pick up license plates from the floor, this officer had turned around and noticed Manship walking

towards this officer. This officer saw Manship withdraw an unknown shiny silver object out of his coat pocket and had cuffed the object with his hands in order to conceal the item from police. This officer asked Manship what he was doing and verbally advised him to back up from police. Manship stopped a short distance from this officer's position behind a store shelf and had fully extended his arms forward and pointed his hands towards this officer while his hands were still cupped over a silver object. At this time this officer felt unsafe with Manship being too close to myself and Ofc. Spaulding and did not know at this time what Manship was concealing with his hands. This officer asked Manship again what he was doing and what he was concealing in his hands. Manship at this time still did not answer this officer. For officer safety, this officer walked towards Manship and asked him if what he was holding was a video camera. As this officer was approaching Manship. Manship stated that he was documenting what was taking place inside the store. Not knowing if Manship was holding a camera or a possible weapon this officer asked Manship to show me what was in his hands. Manship did not answer this officer and had held his arms high over his head so that this officer could not see what he was actually holding and then bladed his body in a aggressive manner. Manship was taller then this officer and could not tell what Manship's intentions were at this J

time. This officer grabbed Manship's left arm with my hand and asked him to show me what he was holding. Once grabbing Manship's arm this officer felt Manship tighten up his muscles in his arms and he immediately started to yell" I'm a priest and you cannot touch me". Manship kept repeating this statement and was alarming other people inside the store. This officer advised Manship that he was making a scene inside the store and advised him to let me see what he was holding or police would arrest him. Manship started to fight with this officer and was turning his body and arms away from this officer while attempting to pass the object over to a nearby male subject. Ofc. Spaulding at this time had grabbed the object from Manship's hands as he was attempting to give the item to the male subject. At this time this officer advised Manship that he was being placed under arrest and advised him to place his arms behind his back. Manship did not answer this officer and started to walk away from this officer while I was still holding onto his left arm. Manship briefly struggled with this officer and refused to place his hands behind his back and this officer had to physically pull down Manship's right arm behind his back in order to place him into hand cuffs. Once handcuffed, this officer double locked the hand cuffs and checked them for fit.

Once secured, this officer saw that the item Ofc. Spaulding had taken from Manship was a very small silver Casio d~gitalcamera. This officer had seized this camera as evidence and had secured the camera in my pocket at this time. This officer and Ofc. Spaulding had escorted Manship out of the store and placed him inside of Ofc. Spaulding's police cruiser. This officer had radioed police headquarters and advised them that I had a male arrestee at my current location. A short time later Sgt. Miller arrived on scene and was briefed on this incident by this officer. Sgt. Miller had spoken with Manship on scene, who identified himself as a priest. Manship during the time of the arrest was wearing a large over coat that concealed his priest attire. Manship explained to Sgt. Miller that he was doing an investigation on behalf of St. Rose's church in New Haven because of recent complaints made by hispanic people who attend his church. Manship accused the East Haven Police Department of racial profiling hispanic gender people who live and drive through East Haven. Furthermore, Manship stated that he was working with people from Yale University and other organizations to help illegal citizens protect their rights while living in the New Haven area. This officer placed the seized camera inside a plastic evidence bag and secured the camera inside my police vehicle. After being briefed, Sgt. Miller had transported Manship back to police headquarters were at police headquarters Ofe. Tracy had processed, fingerprinted, photographed, and charged Manship for C.G.S. 53a-167a, Interfering with a police officer, and 53a-182, Disorderly Conduct. Manship was later released on a WPTA and has a court appearance on 3/4/09. At police headquarters this officer filled out and submitted a inventory of property seized without a search warrant form and submitted it with this police report. The seized Casio camera was tagged as evidence and placed inside the EHPD evidence room. (See Ofc. Spaulding police report CN#09-2(50).
