CRITICAL ANALYSIS OF THE HUMAN DNA PROFILING BILL, 2015
ABSTRACT
DNA, or deoxyribonucleic acid, is the hereditary material in humans and almost all other organisms. Mostly it is located in the cell nucleus (where it is called nuclear DNA), but a small amount of DNA can also be found in the mitochondria (where it is called mitochondrial DNA or mtDNA). In the recent times, Courts, police investigations and the medical experts have relied heavily upon the available DNA database. However, there is much hullabaloo about the lack of proper laws, the vague language and whether these samples are of actual value or not. This paper defines DNA and gives a brief background regarding the evolution it brought in the field of Forensic science. Further, it discusses the relationship between forensic science and law; the application of DNA evidence in medical, agricultural and legal fields. The DNA Bill of 2007 and the Human DNA Profiling Bill, 2015 have been critically analysed. The paper ends with a few suggestions for the upcoming laws. The aim is to define the concept and set out the need, application and improvements required for proper implementation of laws on DNA evidence and delivery of justice.
