PREAMBLE We, the one Party, recognize the need for the student’s active participation in the University. With the help of the Almighty God, we uphold the significant roles that the students play in the realization of a better Society of Legal Executives. One Party helps build true youth leaders so they may commit themselves in full servitude to their fellow students and to the citizens, as a whole. With this, the members do ordain and promulgate this constitution. ARTICLE I NAME The Official name of the Party shall be known as “One Party.” ARTICLE II Declaration of Principles and Purpose Section 1. One Party recognizes the vital role of the students and the youth in society and considers it their duty and responsibility to enhance values and virtues of a responsible citizen in preparation for the challenges of our nation. Section 2. One Party believes in the competence of the university, and specifically recognizes the mission and goal of the SOLEX. Section 3. One Party lives with the purpose of promoting activities that seek to develop and strengthen friendship among all its members and most importantly help the Legal Management Majors in their studies. ARTICLE III MEMBERSHIP Section 1. One Party shall be composed of voluntarily joined students of University of San Carlos students enrolled in Bachelor of Science in Business Administration Major in Legal Management. Section 2. The membership shall be voluntary and will not be automatically considered when enrolled in Legal Management Major. Section 3. The membership shall run for the entire time having been enrolled in Legal Management Major or until member may wish whichever comes first. ARTICLE IV OFFICERS Section 1. The elected officers of the One Party shall be: 1.1 1.2 1.3 1.4 1.5 1.6

President Vice President Secretary Treasurer Auditor (2) year level representatives

Section 2. The elected officers shall legitimately conduct their duties right after their duly proclamation and only until the proclamation of the next batch of officers. Section 3. The party shall recognize appointed Officer(s). Only the president has the right to appoint any other officer. Section 4. The Elected officers shall comprise the Executive Board. ARTICLE V FUNCTIONS AND QUALIFICATIONS OF THE OFFICERS Section 1. The One Party shall have the following set of officers with following functions:

1.1 The President a.To call or preside over special or regular meetings of the Executive Board. b.Authorize the disbursement of funds and the use of all One Party properties. c.Execute and enforce policies, proclamations and resolutions of the Party. d.Implement and supervise all the programs and activities of the Party. e.Represent the Party in all matters affecting its interest.

f.Delegate powers and functions to any officer or to any member of the political party, as he may deem necessary. As well as exercising his power to appoint. 1.2 The Vice- President a. Performs the duties and functions of the President in case of the latter’s absence, death, permanent disability, resignation or removal from office due to impeachment. b. Assist the President in the performance of his duties and functions. c. Supervise the work of the committees. d. Performs such other duties and functions as may be delegated by the President. 1.3 The Secretary a. Be the official custodian of all official records and properties of the Party b. Prepare all reports, documentations, permits and forms. c. Assists the President in the preparation of the meetings’ agenda. d. Performs such other duties and functions as may be delegated by the President. 1.4 The Treasurer a. He is responsible for the safekeeping of all the monetary acquisition and property of the Party. b. Must keep an updated record of the financial status of the Party. c. Submits a financial statement every month to the Auditor of the Party. d. Performs such other duties and functions as may be delegated by the President. 1.5 The Auditor a. Submits a monthly audit report to the Executive Board. b. Certify the authenticity of all financial reports issued by the Treasurer. c. Reports any discrepancy of financial transaction to the Executive board. d. Performs such other duties and functions as may be delegated by the President. 1.6 Year Level Representatives a. Responsible for the dissemination of information from the Party to its year level members. b. Responsible in reporting to the Committee and the general membership whatever issues may affect the Party. c. The official spokesmen of the Party. Section 2. No person shall be elected to any position in the One Party unless he has the following qualifications: 2.1 He must be a bona fide member of the One Party at the time of his election and during his entire tenure as an officer of the One Party. 2.2 He must not have a failing grade or more than one dropped subject in the semester/ term immediately preceding this election. 2.3 He must be a member of good standing of the One Party at the time of his election. 2.4 The person/s elected as President must be an incoming 4th year student. Section 3. The first qualification mentioned in the preceding section shall not apply to new members in accordance with the principle of maximizing membership representation in the Committee. ARTICLE VI COMMITTEES Section 1. The president shall appoint the following committees: 1.1 The Committee on Membership a. Take charge in the planning and conducting an orientation program for the students regarding the Party. b. Compile all membership forms and submit to the President the roster of members of the Party. c. Perform such other functions as may be delegated by the President. 1.2 The Committee on Ways and Means a. Assist the Treasurer in the performance of his duties. b. Takes charge in the planning and conducting of all fund raising activities of the Party. c. Perform such other functions as may be delegated by the President. 1.3 The Committee on Justice, Laws and Amendments

Resolve conflicts regarding the interpretation of the provisions in the Constitution and By-laws of the Party. Take charge of the legal and procedural requirements regarding the implementation of Party programs and projects. Perform such other functions as may be delegated by the President.

Section 2. Each of the three committees shall have a Chairman and not less than four members appointed by the President from the members of the Party. Section 3. The President may create special committees whose members are from the general membership of the Party. ARTICLE VII MEETINGS Section 1. The regular meeting of the party shall be held every Saturday of the month. Section 2. A quorum shall consist of 2/3 of the members of the party. Section 3. The president may call a special meeting any day of the week upon request of any members indicating urgent and specific issues. Section 4. Regular and special meetings shall be open to the public except where confidential discussion is needed. ARTICLE VIII ELECTION Section 1. Separate election laws, rules and procedures are made to facilitate and administer elections that will occur before the end of the second semester of a school year. Section 2. The Commission on Election shall be responsible for conducting the Election of the party. Section 3. The Incumbent President has the sole discretion and authority in appointing the members of the Commission on Election; preferably belonging to a graduating class of that semester by the time elections is going to be held. Section 4. The proclamation of the officers shall be officially held 2 weeks before the end of the semester. ARTICLE IX IMPEACHMENT Section 1. An elective officer of the One Party may be removed from his position by recall on the following grounds: 1.1 1.2 1.3 1.4

Culpable violation of the Constitution and By-laws of the Party; Gross negligence of duty which may be deemed sufficient to warrant removal from office; Abandonment of office for a period exceeding thirty (30) days; or Commission by any of the act bringing dishonor and injury to the good name and dignity of the Party provided that such act is deemed sufficient to warrant from office.

Section 2.The commission on election shall also be responsible for conducting an impeachment complain and shall have the power to decide for impeachment resulting from a duly recognized proceedings. Section 3. The president shall preside the proceedings except when he is the subject of the impeachment in which case the members of the Committee shall elect a presiding officer from the committee. ARTICLE X AMENDMENTS Section 1. Any member may propose amendments of the Constitution and By-laws. Section 2. Amendments shall take place at a special meeting of the party. Section 3. The Constitution and By-laws may be effectively amended by a 2/3 vote of the members. ARTICLE XI EFFECTIVITY Section 1. This Constitution and By-laws shall take effect five days from the date of approval by the majority of votes in a plebiscite called for that purpose and shall supercede all previous Constitution and By-laws.
