APPLICATION SEEKING PERMISSION TO COMPOUND THE OFFENCE U/S 320(2) OF CrPC, 1973,

MAY IT PLEASE YOUR HONOUR The Complainant and the Accused hereinbefore begs to submit as under –

1. That the accused is the owner of the bike namely Bajaj Pulsar, and the Complainant is the owner of a car namely Hyundai Santro. 2. That the accused was driving his motor bike Pulsar from Kandoli to Bidholi rashly at a high speed of 100 km/hr, which was beyond the permissible limits and met with an accident with the complainant which resulted in the damage of the right side mirror and door of the Santro car owned by the complainant. 3. That the accident took place near XYZ boys hostel which was situated near Bidholi and this negligent act was observed by the owner of XYZ boys hostel which was present near the place of accident. 4. That the parties have agreed to settle the dispute by the act of the accused paying the sum of Rupees 10,000 to the complainant in the court by its permission. 5. That the offence of negligence as per Section 337 that has been committed by the accused is compoundable with the permission of this Hon’ble Court. 6. It is therefore, most humbly, prayed that the Hon’ble Court may be pleased to grant permission to Compound the said offence, and be pleased to dispose of the case as “Compounded” and the said accused be acquitted and oblige.
