Drinking Under the Influence Driving under the influence (DUI) is a term used by most states, including California, Florida and Pennsylvania, for being legally intoxicated or impaired while operating a motor vehicle. The intoxication is typically when a breath, blood or urine test registers a blood alcohol content of 0.08%. Minors under the legal drinking age may be declared under the influence at a lower BAC percentage. Law enforcement may arrest a motorist for being impaired even when their BAC is lower than 0.08%. Driving under the influence of alcohol, driving while intoxicated, drunk driving, drinking and driving, or drink-driving, is the act of operating a motor vehicle after having consumed alcohol or other drugs, to the degree that mental and motor skills are impaired. It is a crime in most countries around the world. If you get stopped for a d.u.i., the officer is required by law to immediately forward a copy of the completed notice of suspension form and any driver license taken into possession, with a sworn report to the DMV. The DMW conducts a review that includes an examination of the officer's report and any test results. If you are 21 years of age or older, took a blood or breath test, or a urine test, and the results showed 0.08% BAC or more: a first offense will result in a 4-month suspension or a second offense within 10 years with result to a 1-year suspension.
