PRELIMINARY PROHIBITORY INJUNCTION ORDER

1 ' I o n August 28, 2008, the Court entered an Order To Show Cause Re: Preliminary

2 ., Prohibitory Injunction ("OSC") and A Temporary Restraining Order ("IRQ"), setting the 3

hearing on the OSC for September 12, 2008. Having considered the evidence submitted by Plaintiff Robin Singh Educational Services, Inc. dba TestMasters ("Plaintiff' or "TestMasters")

in favor of requested Injunction, and the evidence submitted by Defendants Blueprint Test Preparation LLC, Trent Teti, Justin Capuano, Matthew Riley and Jodi Triplett, and each of them

("Defendants") in opposition to the proposed Injunction, and the argument of counsel, the Court

8 hereby grants the request of Plaintiff for an Injunction against the Defendants, and hereby enters 9 the following Preliminary Prohibitory Injunction:

PRELIMINARY PROHIBITORY INJUNCTION ORDER

1. THE COURT HEREBY ENJOINS Defendants (except Defendant Martin), and their

12

agents, servants and employees, and all persons acting under, in concert with, or for them (either

13

directly or indirectly) to cease providing any downloads via the Blueprint Internet site or by any

14

other electronic distribution (e.g. CD or DVD) of any course material, practice tests, instruction

15

session, tutorials, or anything else which has been provided on the Blueprint website (as of

16

August 27, 2008, or at any time in the three months prior) or any similar instruction, training or

17

practice materials relevant to the LSAT test and any similar test. This Preliminary Injunction

18

does not prohibit Blueprint and the related defendants from using Blueprint's website to continue

19

to provide marketing and enrollment services and general information (not including sample

20

course material and the like). This is effective immediately and is a continuation of the terms of

21

the Temporary Restraining Order which is superseded by this order.

THE COURT HEREBY FURTHER ENJOINS Defendants (except Defendant

23

Martin), and their agents, servants and employees, and all persons acting under, in concert with,

24

or for them (either directly or indirectly) that as of 12:01 a.m. Saturday October 4, 2008 (Eastern

25

time) to cease providing LSAT preparation services of any type, in any teaching mode

IT IS FURTHER ORDERED THAT:

As set forth above, Paragraph 1 of this Preliminary Prohibitory Injunction shall be

3 effective upon entry, except that the second paragraphs shall become effective commencing at 4 12:01 a.m. on October 4, 2008 (Eastern Time). Paragraph 1 of this Preliminary Prohibitory 5

Injunction shall continue to remain effective after paragraphs 2 becomes effective. Plaintiff shall post a bond (in addition to the bond already posted by Plaintiff for the

7 TRO), in the amount of $350,000.00 (for a total bond of $400,000.00) by 4:00 p.m. on 8 September 16, 2008 to keep this Preliminary Prohibitory Injunction in effect. Plaintiff shall 9 serve on defense counsel by hand and file proof of proper undertaking in the amount set forth 10

above with this Court (in Department 307 or in the Third Floor clerk's office public filing

11 window at the above referenced court if Department 307 is locked) by 4 p.m. on September 16, 12
