Fractional (shared) Ownership A fractional vacation home is an alternative to owning a year-round second home. This growing trend allows purchasers to tailor their ownership to accommodate their family’s anticipated usage without the investment and ongoing expense and maintenance hassles of whole ownership. Fractional ownership of specified villas at Boca de Iguanas are offered in “shares” or “interests.” Each owner has an undivided, deeded 1/6 interest and the right in perpetuity to a private villa residence. Each of the villas will be divided into a maximum of 6 shares where buyers enjoy all the benefits of ownership without paying an exorbitant price for something they use only occasionally. As with traditional real estate ownership, you can rent it, let friends, family or business associates use it, and/or resell it on the open market.

Each Owner will have four alloted high season weeks and two weeks in low season. Additional space available reservations can be made after all owners have made reservations for their alloted weeks. It allows owners to benefit from other owners not using all of their allotted time. Owners will make reservations using a rotating priority system (owners select their choice of weeks based on rotating priority) With a rotating priority system, owners use a priority or lottery system for making reservations. For example, a 1/6 share owner might have first choice for reservations during one reservation period, but drop to second choice the following reservation period and so on. Storage units for fractional owners allow lock away possessions and personal belongings, so that you have everything you need when you arrive for vacation!

BDI FAQ’s Owning in Mexico It is a common misconception that foreigners cannot own real estate in Mexico, but the reality is that they can. Changes in Mexican law, including NAFTA in 1994 and the Foreign Investment Law of 1993, now allow Americans and other foreigners to own real estate. A renewable 50 year bank trust (Fideicomiso) is created with you, the foreigner owner, as the beneficiary. You can live on the property, sell it whenever you want, or pass it on to your heirs. The bank trust is renewed every 50 years, meaning you and your heirs own the property until you decide to sell. Bank trusts are used to guarantee the owners (beneficiary) of the trust absolute control over their assets, and the trust arrangement does not limit your rights to the property in any way. The Fideicomiso has been established as a secure form of ownership and has facilitated billions of dollars worth of property transactions.

Title Insurance A good rule to follow when purchasing real estate in Mexico is: If you can’t get title insurance... then don’t buy! Title Insurance for the complete Boca de Iguanas development is provided by Stewart Title Company. A title insurance policy provides a financially backed guaranty and ensures the property against fraud, liens, encumbrances or improperly executed documents, and ultimately allows for US based financing of your residence. Although the complete project has insured title, each individual house/condo can also receive individual title insurance through Stewart Title for a one-time fee around $3,000 USD. The bilingual professionals at Stewart Title are also providing the escrow and closing coordination services for the residences at Boca de Iguanas.

Homeowners Association Owners are assured of continuing quality and maintenance through an Annual Assessment fee, which pays for the professional management and operation of all Residence facilities and amenities. Included in these annual fees are funds for maintenance, insurance, refuse removal, legal and accounting services, staff salaries, supplies, and a pro-rata provision for the replacement and refurbishing of BDI facilities. A member-elected Board of Directors establishes budgets and fees on an annual basis. During the early development years, and throughout the developer’s subsidy period, representation on the Board will include primarily Boca de Iguanas management personnel.

Once you enter in the vacation rental program, our property management team takes over, ensuring all aspects of operations – from maintenance and guest needs to repairs and reservations – are met and that condos and houses are left in spotless, top-notch condition. Home owners have the peace of mind knowing their properties are well-cared for while they are away. The catch? There is none. Construction Schedule In order to provide a relaxing beach lifestyle, major construction will only be allowed in the low-season months (May - November). As such, home owners and hotel guests can enjoy the development during the estimated 3-4 years until completion. Minor construction and interior details as well as reparation work can be completed during high-season given they comply with noise by-laws and receive the approval of the Homeowners Association. Residences can be built entirely in approximately 6 months, upon contract and deposit.

Ecosystems of the Costalegre A Coastal Mangrove Mexico’s Pacific coast boasts a rich array of diversity from rocky, cactus-lined cliffs to expansive tropical jungle, isolated beaches, small mountains and lush lagoon systems. It is said to have the same latitude as the Hawaiian islands with a rainy season that lasts only four or five months of the year from July to late October. The forests of the Costalegre are among the richest tropical dry forests in the world, supporting more than 700 species of vertebrates and almost 1,200 species of plants. One of the most threatened ecosystems in the world also thrives here in this delicately balanced chain of life: the mangroves that exist within the lagoons, rivers and streams throughout the Costalegre. Coastal mangroves, like the 400 acres in La Manzanilla and small system located on the Boca de Iguanas development terrain, are part of a complex and fragile ecosystem that connect terrestrial and marine species in a nurturing web of life. A plethora of plant, insect, bird, mammal and reptilian species live in the waters surrounding healthy mangroves and find a safe haven among their woven branches. The deep and acidic, moist soil underlying the mangroves are rich and very productive. Large communities of invertebrates feed on the organic matter deposited at the base of mangroves. Mangrove trees are unique in their ability to remove excess salt from the water in which they thrive, enabling them to live their entire lives in a salt water environment, such as the beach location of the Boca de Iguanas project. Because they grow so close together, their roots and branches become large nets that work as filters letting water flow but stopping harmful sediments that damage reefs. Thus, they help protect the coastline from erosion, storm damage, and wave action while providing a sheltered habitat for crocodiles, herons, key nursery areas for fishes and other wildlife. But mangrove habitats around the world are being destroyed as infrastructure from tourism encroaches on swampy land. Commercial shrimp farming destroys many due to expansion of cultivation ponds which dry waterways and lagoons. One of the mandates of the Boca de Iguanas project is to work in conjunction with ecological conservation groups to investigate and study the impact on these delicate ecosystems and work out solutions to keep them thriving. As an eco-hotel, the project hopes to use the small mangrove system onsite as an enclosed environment to research plausible sustainable solutions that can be introduced around the world to other endangered systems. The devastation of the mangroves wrecks havoc on vital and thriving aquatic forest ecosystems that support abundant food chains from coastal to reef life, and affects many communities, both animal and human.

Once nests are reburied within the safe guard of the Boca de Iguanas property, guests can become involved in the release of newborns as they hatch, and learn first-hand the incredible cycle of life. a) BDI will purchase an ATV for usage at the camp and furnish materials for a small turtle camp. b) Volunteers and visitors are encouraged to help with the camp. c) We are looking for partners, both financial and work related in this camp (universities, conservation groups, local residence and visitors etc) 5) BDI will create bilingual ecological education signage to be posted around the bay informing people of the importance of the mangroves, the local ecosystem and the penalties associated with destroying the ecology. 6) BDI will work with conservation organizations to create children’s educative pamphlets to teach the local children the importance of not damaging the environment. 7) The development will maintain on staff a certified biologist to manage conservation efforts and oversee overall health of mangrove, and make suggestions to protect and ensure the survival of the mangrove. 8)The mangrove will be tested through out the year to monitor its’ health. 9) The mangrove will be cleaned of trash, and items that might obstruct the flow of water to the ocean in rainy season a)The mouth of the mangrove will be opened to the sea during rainy season. 10. The beach area will be cleaned daily; Cars are no longer allowed on the beach (except for emergency issues) to avoid sand compacting at the river mouth. Auto traffic can compact the sand, making it difficult for the mangrove to open naturally. 11. Approximately 100 meters of mangrove will be planted onsite at BDI 12. All sewage created at the project will be treated by a certified biological sewage plant with the cleaned water used for irrigation. A fully contained simple to operate, cost effective and aesthetically pleasant Natural Waste Water Treatment System to clean wastewater to reuse standards without posing undue harm on the surrounding environment. 13. Grey water recycling to encourage less waste and more reuse of the precious resource. Using “green cleaners” – biodegradable detergents, shampoos and soaps – will mean that runoff from showers, dish washing and even pools can be utilized to water the gardens. 14. Rain water collection systems are also being designed to help out irrigation water usage during dry months. 15. BDI will establish a community recycle program for plastics, glass. An onsite compost of organic materials will supply the nitrogen-rich top soil to feed and enrich the garden year-round and also limit waste going into local landfill sites. 16. All houses and the hotel at BDI will include solar energy arrays to supplement existing power grid structures and lessen the impact on the surrounding environment with a clean, natural energy source. Using the sun’s rays to provide electricity and hot water will lower the electrical bill, but will also mean Boca de Iguanas will rely upon using less of another limited resource: natural gas. 17. All houses are designed to Bio-Climatic design… allowing maximized air flow, keeping the houses cool & reducing the need for Air Conditioning. 18. The master plan has been designed to maximize airflow through the property. 19. Master plan has large green areas to promote local animal life, including large areas that will be keep in their natural state. 20. Chlorine use in the swimming pool will be limited as newer eco-technologies, such as ozone and salt based systems will be used to keep the pools clean.
