I am the deponent herein and defendant in the above suit hence I acquainted with the facts of the case. 2. I submit that the suit filed by respondent/plaintiff for the relief of declaration of title on false allegations. 3. I submit that the above suit was posted on 19-10-2018 for filing of written statement. Due to non-filing of written stamen, the Hon’ble court passed the exparty order towards me. My father has been suffering with old age ailments with hepatitis on 19-10-2018 except me no attendant is there to look after my father. As such I unable to went to my counsel office for giving instructions to prepare written statement. I did not inform the same to my counsel. As such my counsel also failed to represent the same before the Hon’ble court. Due to which the Hon'ble court passed the exparty decree dt: 20-12-2018. 4. I am advised to file this application to set aside the ex-parte decree dt: 20-`122018 to enable me for filing of written statement and contest of the suit. I pray the Hon’ble court to set aside the exparty decree dt:20-12-2018 as I having many chances for success of suit and if the Hon’ble court may not set aside the exparty decree dt:20-12-2018 , I will suffer great Lose, which cannot be compensated in terms of money. Therefore I Pray the Hon’ble Court may be pleased to set-aside the exparty decree dt:20-12-2018 as prayed in the petition.
