2. Political Science 2.1. Latest Court Verdicts Supreme Court legalises homosexuality, partially strikes down Section 377 

A Five Judge Constitution Bench of the Supreme Court on September 6, 2018 decriminalised Section 377 of the Indian Penal Code (IPC) by partially striking down some of its provisions.

The bench comprising Chief Justice Dipak Misra; Justices R F Nariman, A M Khanwilkar, D Y Chandrachud and Indu Malhotra ruled that Section 377, to the extent it criminalises sexual acts between consenting adults, whether homosexual or hetrosexual, is unconstitutional.

The Judgement overrules the Suresh Kaushal Judgement pronounced in 2013 by the apex court.

The judgement is based on the interpretation of Article 14 (Right to Equality); Article 15 (prohibition of discrimination on grounds of religion, race, caste, sex or place of birth); Article 19 (Freedom of Speech and Expression); and Article 21 (Right to Life and Right to Privacy) of the Indian Constitution.

WHAT IS SECTION 377?  The section holds that whoever, voluntarily, has carnal intercourse against the order of nature with any man, woman or animal, commits an unnatural offence.  A person found guilty, under Section 377, shall be punished with imprisonment for life, or with imprisonment of either description for a term which may extend to 10 years, and shall also be liable to pay a fine.  Section 377 existed ever since the Indian Penal Code came into existence in 1860.

Supreme Court scraps district panels for dowry harassment cases 

A three-judge bench of the Supreme Court revised a 2017 judgment by a twojudge bench of the apex court that sought to prevent misuse of an anti-dowry law by forming a family welfare committee at the district level to look into complaints before arrests were made, and said the creation of such a panel is beyond the scope of the law.

The ruling puts the onus for the use and possible misuse of section 498A of the Indian Penal Code (IPC) on law enforcement agencies.

The previous order, passed in the Rajesh Kumar vs Union of India case, was seen by some as diluting the law.

The case itself was prompted by the premise that section 498A was sometimes being misused to settle scores.

Adultery not a crime, Supreme Court strikes down Section 497  The court declared that Section 497 of the Indian Penal Code-the adultery law-was unconstitutional.  The Supreme Court unanimously struck down a 158-year-old law that considers adultery to be an offence committed by one man against another, and has been criticized for treating women as possessions rather than human beings.  Misra, who wrote a judgment for himself and Justice AM Khan wilkar, said the unequal treatment of women invites the wrath of the Constitution, and that any provision treating women unequally isn’t constitutional.  The other judges on the bench were Justice RF Nariman, Justice DY Chandra chud, and Justice Indu Malhotra. ARTICLE 497

 Adultery.—Whoever has sexual intercourse with a person who is and whom he knows or has reason to believe to be the wife of another man, without the consent or connivance of that man, such sexual intercourse not amounting to the offense of rape, is guilty of the offense of adultery, and shall be punished with imprisonment of either description for a term which may extend to five years, or with fine, or with both.  In such case the wife shall not be punishable as an abettor. The Belt and Road Initiative (BRI) or the Silk Road Economic Belt and the 21st-century Maritime Silk Road is a development strategy adopted by the Chinese government.

The ‘belt’ refers to the overland interconnecting infrastructure corridors; the Silk Road Economic Belt (SREB) component.

The ‘road’ refers to the sea route corridors; the 21st Century Maritime Silk Road (MSR) component.[2] The initiative focuses on connectivity and cooperation between Eurasian countries, primarily the People’s Republic of China (PRC).

Until 2016 the initiative was known in English as the One Belt and One Road Initiative (OBOR) but the Chinese came to consider the emphasis on the word “one” as misleading.
