Syllabus * Two provisions of the Communic ations Dec enc y Ac t of 1996 (CDA or Ac t) seek to protec t minors from harmful material on the Internet, an international network of interc onnec ted c omputers that enables millions of people to c ommunic ate with one another in "c yberspac e'' and to ac c ess vast amounts of information from around the world. Title 47 U.S .C.A. §223(a)(1)(B)(ii) (S upp.1997) c riminaliz es the "knowing'' transmission of "obsc ene or indec ent'' messages to any rec ipient under 18 years of age. S ec tion 223(d) prohibits the "knowin[g]'' sending or displaying to a person under 18 of any message "that, in c ontext, depic ts or desc ribes, in terms patently offensive as measured by c ontemporary c ommunity standards, sexual or exc retory ac tivities or organs.'' Affirmative defenses are provided for those who take "good faith, . . . effec tive . . . ac tions'' to restric t ac c ess by minors to the prohibited c ommunic ations, §223(e)(5)(A), and those who restric t suc h ac c ess by requiring c ertain designated forms of age proof, suc h as a verified c redit c ard or an adult identific ation number, §223(e)(5)(B). A number of plaintiffs filed suit c hallenging the c onstitutionality of §§223(a)(1) and 223(d). After making extensive findings of fac t, a three-judge Distric t Court c onvened pursuant to the Ac t entered a preliminary injunc tion against enforc ement of both c hallenged provisions. The c ourt's judgment enjoins the Government from enforc ing §223(a)(1)(B)'s prohibitions insofar as they relate to "indec ent'' c ommunic ations, but expressly preserves the Government's right to investigate and prosec ute the obsc enity or c hild pornography ac tivities prohibited therein. The injunc tion against enforc ement of §223(d) is unqualified bec ause that sec tion c ontains no separate referenc e to obsc enity or c hild pornography. The Government appealed to this Court under the Ac t's spec ial review provisions, arguing that the Distric t Court erred in holding that the CDA violated both the First Amendment bec ause it is overbroad and the Fifth Amendment bec ause it is vague. Held: The CDA's "indec ent transmission'' and "patently offensive display'' provisions abridge "the freedom of speec h'' protec ted by the First Amendment. Pp. ____-____. New York, 390 U.S . 629, 88 S .Ct. 1274, 20 L.Ed.2d 195; FCC v. Pacifica Foundation, 438 U.S . 726, 98 S .Ct. 3026, 57 L.Ed.2d 1073; and Renton v. Playtime Theatres, Inc., 475 U.S . 41, 106 S .Ct. 925, 89 L.Ed.2d 29-raises, rather than relieves, doubts about the CDA's c onstitutionality. The CDA differs from the various laws and orders upheld in those c ases in many ways, inc luding that it does not allow parents to c onsent to their c hildren's use of restric ted materials; is not limited to c ommerc ial transac tions; fails to provide any definition of "indec ent'' and omits any requirement that "patently offensive'' material lac k soc ially redeeming value; neither limits its broad c ategoric al prohibitions to partic ular times nor bases them on an evaluation by an agenc y familiar with the medium's unique c harac teristic s; is punitive; applies to a medium that, unlike radio, rec eives full First Amendment protec tion; and c annot be properly analyz ed as a form of time, plac e, and manner regulation bec ause it is a c ontent-based blanket restric tion on speec h. These prec edents, then, do not require the Court to uphold the CDA and are fully c onsistent with the applic ation of the most stringent review of its provisions. Pp. ____-____. (c ) The spec ial fac tors rec ogniz ed in some of the Court's c ases as justifying regulation of the broadc ast media-the history of extensive government regulation of broadc asting, see, e.g., Red Lion Broadcasting Co. v. FCC, 395 U.S . 367, 399-400, 89 S .Ct. 1794, 1811-1812, 23 L.Ed.2d 371; the sc arc ity of available frequenc ies at its inc eption, see, e.g., Turner Broadcasting System, Inc. v. FCC, 512 U.S . 622, 637-638, 114 S .Ct. 2445, 2456-2457, 129 L.Ed.2d 497; and its "invasive'' nature, see Sable Communications of Cal., Inc. v. FCC, 492 U.S . 115, 128, 109 S .Ct. 2829, 2837-2838, 106 L.Ed.2d 93-are not present in c yberspac e. Thus, these c ases provide no basis for qualifying the level of First Amendment sc rutiny that should be applied to the Internet. Pp. ____-____. (d) Regardless of whether the CDA is so vague that it violates the Fifth Amendment, the many ambiguities c onc erning the sc ope of its c overage render it problematic for First Amendment purposes. For instanc e, its use of the undefined terms "indec ent'' and "patently offensive'' will provoke unc ertainty among speakers about how the two standards relate to eac h other and just what they mean. The vagueness of suc h a c ontent-based regulation, see, e.g., Gentile v. State Bar of Nev., 501 U.S . 1030, 111 S .Ct. 2720, 115 L.Ed.2d 888, c oupled with its inc reased deterrent effec t as a c riminal statute, see, e.g., Dombrowski v. Pfister, 380 U.S . 479, 85 S .Ct. 1116, 14 L.Ed.2d 22, raise spec ial First Amendment c onc erns bec ause of its obvious c hilling effec t on free speec h. Contrary to the Government's argument, the CDA is not saved from vagueness by the fac t that its "patently offensive'' standard repeats the sec ond part of the three-prong obsc enity test set forth in Miller v. California, 413 U.S . 15, 24, 93 S .Ct. 2607, 2614-2615, 37 L.Ed.2d 419. The sec ond Miller prong reduc es the inherent vagueness of its own "patently offensive'' term by requiring that the prosc ribed material be "spec ific ally defined by the applic able state law.'' In addition, the CDA applies only to "sexual c onduc t,'' whereas, the CDA prohibition extends also to "exc retory ac tivities'' and "organs'' of both a sexual and exc retory nature. Eac h of Miller's other two prongs also c ritic ally limits the unc ertain sweep of the obsc enity definition. Just bec ause a definition inc luding three limitations is not vague, it does not follow that one of those limitations, standing alone, is not vague. The CDA's vagueness undermines the likelihood that it has been c arefully tailored to the c ongressional goal of protec ting minors from potentially harmful materials. Pp. ____-____. (e) The CDA lac ks the prec ision that the First Amendment requires when a statute regulates the c ontent of speec h. Although the Government has an interest in protec ting c hildren from potentially harmful materials, see, e.g., Ginsberg, 390 U.S ., at 639, 88 S .Ct., at 1280, the CDA pursues that interest by suppressing a large amount of speec h that adults have a c onstitutional right

to send and rec eive, see, e.g., Sable, supra, at 126, 109 S .Ct., at 2836-2837. Its breadth is wholly unprec edented. The CDA's burden on adult speec h is unac c eptable if less restric tive alternatives would be at least as effec tive in ac hieving the Ac t's legitimate purposes. S ee, e.g., Sable, 492 U.S ., at 126, 109 S .Ct., at 2836-2837. The Government has not proved otherwise. On the other hand, the Distric t Court found that c urrently available user-based software suggests that a reasonably effec tive method by whic h parents c an prevent their c hildren from ac c essing material whic h the parents believe is inappropriate will soon be widely available. Moreover, the arguments in this Court referred to possible alternatives suc h as requiring that indec ent material be "tagged'' to fac ilitate parental c ontrol, making exc eptions for messages with artistic or educ ational value, providing some toleranc e for parental c hoic e, and regulating some portions of the Internet differently than others. Partic ularly in the light of the absenc e of any detailed c ongressional findings, or even hearings addressing the CDA's spec ial problems, the Court is persuaded that the CDA is not narrowly tailored. Pp. ____-____. (f) The Government's three additional arguments for sustaining the CDA's affirmative prohibitions are rejec ted. First, the c ontention that the Ac t is c onstitutional bec ause it leaves open ample "alternative c hannels'' of c ommunic ation is unpersuasive bec ause the CDA regulates speec h on the basis of its c ontent, so that a "time, plac e, and manner'' analysis is inapplic able. S ee, e.g., Consolidated Edison Co. of N.Y. v. Public Serv. Comm'n of N.Y., 447 U.S . 530, 536, 100 S .Ct. 2326, 2332-2333, 65 L.Ed.2d 319. S ec ond, the assertion that the CDA's "knowledge'' and "spec ific person'' requirements signific antly restric t its permissible applic ation to c ommunic ations to persons the sender knows to be under 18 is untenable, given that most Internet forums are open to all c omers and that even the strongest reading of the "spec ific person'' requirement would c onfer broad powers of c ensorship, in the form of a "hec kler's veto,'' upon any opponent of indec ent speec h. Finally, there is no textual support for the submission that material having sc ientific , educ ational, or other redeeming soc ial value will nec essarily fall outside the CDA's prohibitions. Pp. ____-____. (g) The §223(e)(5) defenses do not c onstitute the sort of "narrow tailoring'' that would save the CDA. The Government's argument that transmitters may take protec tive "good faith ac tio[n]'' by "tagging'' their indec ent c ommunic ations in a way that would indic ate their c ontents, thus permitting rec ipients to bloc k their rec eption with appropriate software, is illusory, given the requirement that suc h ac tion be "effec tive'': The proposed sc reening software does not c urrently exist, but, even if it did, there would be no way of knowing whether a potential rec ipient would ac tually bloc k the enc oded material. The Government also failed to prove that §223(b)(5)'s verific ation defense would signific antly reduc e the CDA's heavy burden on adult speec h. Although suc h verific ation is ac tually being used by some c ommerc ial providers of sexually explic it material, the Distric t Court's findings indic ate that it is not ec onomic ally feasible for most nonc ommerc ial speakers. Pp. ____-____. (h) The Government's argument that this Court should preserve the CDA's c onstitutionality by honoring its severability c lause, §608, and by c onstruing nonseverable terms narrowly, is ac c eptable in only one respec t. Bec ause obsc ene speec h may be banned totally, see Miller, supra, at 18, 93 S .Ct., at 2611-2612, and §223(a)'s restric tion of "obsc ene'' material enjoys a textual manifestation separate from that for "indec ent'' material, the Court c an sever the term "or indec ent'' from the statute, leaving the rest of §223(a) standing.
