Mr. Tolbert thank you for taking the time to speakwith me on November 1, 2006. This letter is in referenceto my terminationthat took place on October 24th,2006,Mr. Tolbert this is my official letter of appealgrantedby the PelicanBay Police Policy and Procedure handbook. Mr. Tolbert,on October24'h,2006at approx.2:40pm,I was calledby PelicanBay Police Officer SergeantWarren O'Donley. SergeantO'Donley askedme if I had my voice recorderwith me on Saturday,October zft,2006.I advisedI did have it with me on Saturday.SergeantO'Donley statedthat I neededto bring it in. When I askedwhy i neededto, I was told, "Don't worry aboutit, we just needit". I did adviseSergeant O'Donley that the cassettetapewas my personaltape and I would like to know why he neededit. I was told by SergeantO'Donley that if I didn't bring it, "I would be sorry". I advisedSergeantO'Donley that I would gladly turn in my tape if he would senda formal requeston a letter head. Chief Frankum then got on the phone and asked me why I was giving them a hard time aboutthis. I explainedthat I didn't have a problem nor was I trying to give anyone a hard time. Chief Frankum then abruptly fired me over the phone. Chief stated,"Your fired, you do not work here anymore,you got that!" " Turn in your badge and ID". I called and e-mailed Chief Frankum severaltimes to try and resolve the situation.At approx.4:48pm,I receiveda calledfrom SergeantO'Donley's cellular phone.Officer David Shefieldwas the one that called. Officer Shefield advisedthat Chief Frankum statedthat he did not want me calling or e-mailing him anymore. I advised Shefieldthat I wouldn't. Mr. Tolbert, Chief Frankum does not have the final authority when it comes to firing an Officer. The City Council does.This is documentedin the PelicanBay Police Policies. So why is it that Chief Frankum sentthe F-5 (Notice of Seperation)to Tcleoseon October24rn,2006?I would have expectedto be placedon suspensionpending final decisionfrom the City Council. I would also like to add that the PelicanBay Police policy doesnot cover anything aboutpersonalpocketrecordersor having to turn them in for review. Mr. Tolbert I addeda copy of the TexasGovernmentCode Chapter614. Sec. 6L4.023. COPY OF COMPLAINT EMPLOYEE.

Mr. Tolbert, on October,26'n 2006,I contactedTexas Ranger Harmon from the Texas Departmentof Public Safety's Fort Worth office and advisedhim of the situation.Ranger Harmon advisedthat since nothing was statedin the City policy about personalrecorders that there was possiblemisconduct.RangerHarmon advisedthat only the DA in Tarrant County can requesta formal inquiry for him to look into it. Ranger Harmon advisedme who I neededto contactat the DA's office. I feel this situation got totally blown out of proportion. It is also my opinion that Chief Frankum made this into a personalvendettaagainstme. A11that I ask is that the Council review the information without prejudice and make a decision. I would like to be reinstatedto my position as a Police Officer or have my F-5 amended to reflect an Honorable Discharge and my resignation.Although there is no monetary loses, I will seeklegal action in this matter.
