Notice of Violation: NSPS § 60.752 – Gas Collection at MSW Landfills RE: Odor Complaint Investigation Complaint No. 8/09-30 & 9/09-04 SDP Permit No. 52-SDP-01-72 Dear Mr. Elias: On August 21, 2009 and September 3, 2009, this office received two complaints regarding odor from the Iowa City Sanitary Landfill. This office has been aware that residents nearby to the landfill had experienced odor in the late winter into the spring of 2009, and that you were working on expanding the gas collection system within the landfill, as is required in New Source Performance Standard (NSPS) WWW. NSPS WWW requires that landfills whose NMOC emission rate equal to or greater than 50 megagrams per year collect gas within 5 years of waste being placed into a cell. It has come to our attention that waste has been in cell FY02 for approximately 5 years and 9 months prior to gas collection being installed. It is difficult to determine if the abnormal odor has been a result of the excessive amount of wet waste from the Flood of 2008 or the extra time waste has been in place without gas collection in cell FY02. NSPS § 60.752 - Standards for air emissions from municipal solid waste landfills. ( 2 ) Collect gas from each area, cell, or group of cells in the landfill in which the initial solid waste has been placed for a period of: ( i ) 5 years or more if active.

During this complaint investigation, you indicated that to keep this from occurring again in the future, the Iowa City Sanitary Landfill’s environmental consultant is developing a “gas system operating plan” and “long range gas system expansion plan”. Please ensure the landfill complies with the above listed NSPS regulations in the future.
