HOMESTEADS A.P. occupants of Homesteads (conferment of ownership) Act, 1976.

Girt of Contents

Homestead means the site of any dwelling house, built by a landless agriculturist ( i.e. having less than Ac.2.5 of wet or Ac. 5.00 of dry lands). Agricultural laborer or artisan at his own expense or at the expense of his predecessor go includes other area adjacent to the welling house necessary for its convenient, enjoyment go belonging to a land owner. Prohibits eviction of an occupant of a homestead who is in occupation of a dwelling houses as on 14-08-1975, unless the land owner proes that the dwelling was built at his expense and the occupant is a tenant. The act provides for restoration of possersion to an occupant of homestead who in occupation of a dwelling house on or after 510-1971 but evicted before 14-08-1975 by the M.R.O. on an application made or svomoto at any time. After occupation is restored, the occupant of the homestead shall become the owner of homesteads go dwelling house subject to the extent of homestead not exceeding five cents (0-02 guntas) and the right conferred is heritable go not alienable.

ASSIGNED LANDS THE A.P ASSIGNED LANDS (PROHIBITION OF TRANSFER ) Act, 1977

This is a protective legislation which came into force on 21-01-1977. the Act prohibits transfer of lands assigned to landless poor persons for the purpose of cultivation or as house – sites go provides for restoration of such transferred lands to the original assignee go also for punishment to the persons acquiring such lands. At prohibits transfer of any land assigned to a landless poor person by way of sale, gift, moretage, exchange, lese or otherwise go no right or title or right in such assigned land shall vest in any parson acquiring – the land. The transferred assigned lands taken shall be restored to the original assignee or his legal heirs, only once. If the restored land is again transferred by the assignee or his legal heirs, it shall be resumed back to the Govt. for assignment to any other landless poor person. The registering officer shall not register any document relating to transfer of or creation of any interest in assigned lands without prior permission of the District Collection.

RECOVERY

This act enables the Govt. to recover (i) a mean of public revenues go certain other amounts due to the Govt. (ii) dues to banks go notified public bodies (iii) dues from persons from whom money is due by the defaulter by adopting due procedure.

THE A.P. REVENUE RECOVERY, ACT,1864

The costs awarded by the state Govt. by various counts can also be recovered as a means of land revenue under this act. A mean of Revenue shall be interest b/0 after the close of the fasli in which it fell due. This act provides for I) Distrait go sale of movable property. ii) Attachment go sale of immovable property. iii) Arrest go defection of the defaulter. When a means of Revenue with interest go costs cannot be liquidated by sale of property of the defaulter or his surety go it the R.D.O. has reason to believe that the defaulter or his surety is willfully with – holding payment o a near or has been guilty of fraudulent conduct in order to evade payment , it shall be lawful by the R.D.O. to cause imprisonment of the defaulter or his surety, not being a female up to 2years subject to the prescribed limitation.

SUMMONS THE A.P REVENUE SUMMONS, ACT,1969

Collector , Sub – Collector , Assistant Collector, Tahsildar & Deputy Tahsildar are empowered to issue summons in from –I requiring the attendance of any person for giving evidence or both for giving evidence do to produce any document article, in any enquiry pending before hem. The summons shall be served on the person summoned for giving evidence is unable from securer or infirmity to attend before the officer issuing the summons or is a person, whom by reason of rank or sex, it may not be proper to summon the officer issuing the summons may dispense with the appearance of such person go order him to be examined by a sub – ordinate deputed by such office. Persons summoned for giving evidence, upon attendance shall be entitled to traveling allowance ( it the distance traveled is 8.kms or more) go the party at whose instance, such summons are issued shall deposit amount equal to the traveling allowance go no summons shall be issued until the amount been deposited .

WELLS :Every owner of the existing well / bore has to register it. Permission for new well / bore have to be obtained. Private bore wells can be taken by Govt. for ensuring drinking water. Every rig has to be regiotoud.

SAND MINING:In areas where sand mining is affecting ground water regime, such of the areas, shall be notified go mining go transportation of can be banned. TREES:Every owner of a residential area / commercial area shall have to plant trees. No trees can be felled without the written permission of forest Department. For every felled tree, two trees have to be planted at the same place or at a suitable place.
