Police Power (scope/characteristics) Ichong vs. Hernandez G.R. L-7995 May 31, 1957

Facts: R.A. 1180 or also knows as “An Act to Regulate the Retail Business” was passed. This law prohibits aliens from doing retail business in the Philippines. However, Americans are not affected by the law.

Issue: WON the law is valid?

Held: Yes, it is a valid exercise of police power. The law does not violate the equal protection clause because there are sufficient grounds that exist for the distinction between an alien and a citizen in the exercise of the occupation regulated. Nor does it violate the due process of law clause because that is prospective in operation and recognizes the privilege of aliens already engaged in the occupation and reasonable protects their privilege.
