PILGRIMAGE (HAJJ) The meaning of Hajj (pilgrimage) Literally: going to a sacred place. Legally: To set out for the Ka’ba in order to perform specific rites of worship Hajj is one of the pillars of Islam, and an individual obligation on whoever is able. One who denies that hajj is olibgatory become an unbeliever (kair) unless he is a new covert to Islam or has been raised away from scholars. For Hajj is a physical and financial act of worship. The Evidence that Hajj is obligatory: The Quran: Surat al-Imran, 97: Allah says : Hajj to the House(ka’bah) is a duty that mankind owes to Allah, those who can afford the expenses and whoever disbelieves, then Allah stands not in need of the any of the ^aalmin ( mankind, jinn and all that exists, means his creatures.) The Sunnah: Ibn Umar narrated in al-Bukhariyy The Meseenger of Allah siad “ Islam is built upon five: Testifying there is no god but Allah and that Muhammad is the Messenger of Allah, performing the prayer ,giving zakat, making hajj, and fasting ramadan. Haddith: the scholars concentious from the time of the companions of the prophet (pbuh) until our day and has concluded that Hajj is a solid obligation in all able person once in a lifetime. Who Must Perform Pilgrimage (Hajj) The only conditon for validity is Islam. Hajj and Umra are not accepted from a disbeliever or an apostate, as they are not qualified for worship. A parent or guardian can make ihram on behalf of a Muslim child who has not reached the age of discrimination and perform the acts for him. It is accepted if performed by a child and he is rewarded for it, but it does not exempt him from the obligatory Hajj of Islam.
Performing Hajj and ^Umrah once in a lifetime is obligatory upon the Muslim who is complete free, accountable (Islam, pubessencesanity), and can afford to reach Makkah and return to his homeplace. The Conditions for it to count as the obligatory hajj of Islam 1- Islam 2- Sanity 3- Puberty 4- Ability Ability to perform Hajj in person 1) Having the provision and the expense for the trip to Mekka and back. This includes that one has in excess of his debts, appropriate lodging and clothing, and what he is obligated to spend on those whom he must support from his departure until his return. This includes helping one’s father to get married if one’s father needs it. 2) Having a suitable means of transport. 3) The routes must be safe However, if one knows that one may be killed or robbed on the way to Hajj, then one is not obligated to go to Hajj. 4) Bodily health 5) The Ability to set off for Hajj in time to perform Hajj. Who Must Perform Pilgrimage (Hajj) The only condition for validity is Islam. Performing Hajj and ^Umrah once in a lifetime is obligatory upon the Muslim who is complete free, accountable (Islam, pubessence, sanity), and can afford to reach Makkah and return to his home place. Scholar consensus from the time of the companions of the Prophet(pbuh) until our day has concluded that Hajj is a solid obligation on every able person, once in a lifetime.
Perform Hajj by sending another 1) If one can not perform Hajj because of chronic disease, old age, or incurable disabling illness, if he is severely sick and can not ride to travel, and has enough money ,one may pay someone to do it on his behalf, then it is obligatory on him because he can send some one to do it for him. 2) If he can’t perform in person and has no money, but has an obedient son who is able to, then it is obligatory on the father and he must order his son to do it on his behalf.
How many times we shall perform Hajj? In Sharia, Hajj is not obligatory more than once in one’s lifetime. Scholar consensus also it is a solid obligation on every able person one in a lifetime. Abu Hurayrah said” The Messenger of Allah addressed us and said “O people, Allah made Hajj obligatory for you so perform Hajj.’ A man said” O Prophet of Allah, every year? He did not answer, until the man repeated the question three times. The Prophet (pbuh) said” If I say yes, it will become obligatory, and you will not be able to fulfill it.” – (Hadith Muslim Vol.2) Also the Prophet (pbuh) did not perform Hajj after it became obligatory except once, the farewell hajj. A stranger may perform hajj on behalf of a deceased (even without the consent of the deceased or his guardian’s consent), just like he can pay off some one else’s debts. So it is permissible for some one volunteer to perform Hajj on another behalf at no cost. Note: The delegate must be Muslim, over age of puberty, sane, trust-worthy, and has performed his own obligatory hajj of Islam. As to hajj, there is no difference in opinion with regards to the one who is able. Allah scholars hold the consensus that is obligatory on the one who is able. Imam Malik said that one who is able has to perform Hajj immediately, that is, one who has to go to Hajj in the same year.
Imam ash-Shai^yy said that one is entitled to delay it as long as one performs it before death. Two condition are exclusive to women: 1)-The woman shall find a mahram (unmarried man) to accompany her to Hajj. The Prophet said in hadith narrated by Abu Dawud : it means “ A woman is not allowed to travel the distance of half a day without the company of unmarried male (mahram) with her. If she can’t, she may go with two or more trustworthy women, if she can find them and feel safe with because danger is eliminated when they are in a group. A woman should not perform hajj, be it obligatory or not without her husband’s consent. If he presents her, then she must not leave for performing it. If this woman die because of the delay, the hajj should be performed on her behalf from her inheritance, and she is Not considered disobedient, unless she was able to perform hajj before marriage. Nafe narrated from Ibn Umar that the Prophet (pbuh) said about a woman who was married and had money but whole husband did not allow her to perform Hajj: She must not depart without her husband’s consent. 2)- A woman should not be in idda because of divorce or the death of her husband. Quran 65:1 said: Don’t turn them (women) out of their houses, nor shall they themselves leave. About the Child Hajj It is valid for a child for Hajj, the child has to be in the state of mental discrimination (mumayyiz), and has to take his state of mental discrimination, and he has to take guardian’s permission. He will be rewarded for the Hajj he performed, but it does not exempt him from the obligatory Hajj of Islam (means he need to do it again when after he reach puberty when he is able to perform the obligatory Hajj) 7 is the age of child
If the child is not in the state of mumayyiz, then the guardian makes the intention on his behalf (I intend ihram for Hajj/umra on behalf of xxx ).
