Dear Sir, Sub: Pending rebate claim of Rs. 30,07,800/- in terms of order passed by Joint Secretary, Government of India, Ministry of Finance, Department of Revenue vide order no. 99/2001 dated 30.10.2001. This is to bring to bring to your kind attention that our rebate claim of Rs. 30,07,800/arising out of order passed by Joint Secretary, Government of India, Ministry of Finance, Department of Revenue vide order no. 99/2001 dated 30.10.2001 has been pending since then. As desired by you, on visit of our authorized representative Mr. Vinay Kumar Shraff, Chartered Accountant to your office on 28th December, 2004 to pursue our claim, we briefly present the history of our case for your reference as follows:1) A show cause notice under C.No. V(18)(85)24/Rebate/DDD-I/99/5993 dated 13.10.99 was served upon the assessee by the Dy. Commissioner of C.Ex., Dum Dum I Division for rejection of our said rebate claim of Rs. 30,07,800/-. 2) After granting personal hearing on 22.12.99 our claim was rejected vide order-inoriginal no. V(18)(85)24/Rebate/DDD-I/99/104 dated 06.01.2000. 3) Further our appeal against the above order was also rejected by Commissioner of Central Excise( Appeals), Calcutta vide Order-In-Appeal No. 45/Cal-III/2000 dated 18.12.2000. 4) However in response to our revision application, Joint Secretary, Government of India, Ministry of Finance, Department of Revenue, passed an order in our favor granting the refund of Rs. 30,07,800/- subject to verification of all original documents by the jurisdictional Divisional Officer, vide order no. 99/2001 dated 30.10.2001. 5) However inspite of our regular remiders and letters from time to time for granting of our rightful claim after completion of necessary formalities no action has been taken. Kindly look into the matter at your earliest for settlement of our already long overdue refund claim. We should also be granted interest on delayed refund in terms of section 11BB of Central Excise Act, 1944 after expiry of three month of date of order no. 99/2001 dated 30.10.2001.

We hereby enclose copy of the above order and copies of our original claim for refund.
